written objection is filed

with the Finance Direc-

prior to the hearing or

presented to the

presiding officer at the

hearing.

After the public hearing

the City Council may

adopt the proposed

special assessment

roll. You will have 30

days from the adoption

date to pay the entire

final special assess-

ment amount to the

City Finance Depart-

ment. After such time,

you may pay the Coun-

ty Auditor the entire

amount

of the assessment

remaining unpaid. The

unpaid balance of any

assessment will be

levied by Brown Coun-

ty and will be collected

as an assessment on

your property tax

statement the following

year.

An owner may appeal

an assessment to dis-

trict court pursuant to

Minnesota Statutes

Section 429.081 by

serving notice of the

appeal upon the Mayor

or Finance Director of

the City within 30 days

after the adoption of

the assessment and fil-

ing such notice with the

district court within

ten days after service

upon the Mayor or Fi-

nance Director. Under

Minnesota Statutes,

Sections

435.193 to 435.195,

the Council may, in its

discretion, defer the

payment of this special

assessment for any

homestead property

owned by a person 65

years of age or older

for whom it would be a

hardship to make the

payments. When

deferment of the spe-

cial assessment has

been granted and is

terminated for any rea-

son provided by law, all

amounts accumulated

plus

applicable interest be-

come due. Any as-

sessed property owner

meeting the require-

ments of this

law and City Code

Section 2.80 adopted

under it may, within 30

days of the confirma-

tion of the

assessment, apply to

the Finance Director

on such forms as are

prescribed by the

County Auditor

for such deferral of

payment of this special

assessment on his

property.

The proposed assess-

ment rolls are on file

for public inspection at

the City Finance

Director’s office. Writ-

ten or oral objections

will be considered at

the public hearing. No

appeal may be taken

as to the amount of

an assessment unless

a signed, written objec-

tion is filed with the City

Finance Director prior

to the hearing or

presented to the

presiding officer at the

hearing.

After the public hear-

ing, the City Council

may adopt the pro-

posed special assess-

ment roll. You will have

30 days from the adop-

tion date to pay the en-

tire final special as-

sessment amount to

the City Finance

Director’s Office

without interest. After

such time, you may

pay to the County Au-

ditor the entire amount

of the assessment,

plus interest for twelve

(12) months of the next

year and 46 days of

this year and shall bear

interest at the rate of

5% per annum. The

unpaid balance of any

assessment and in-

terest, will be levied by

Brown County and will

be collected as an as-

sessment on your pro-

perty tax statement the

following year.

An owner may appeal
