Brown County District Court

• Robert D. Bauer, 40, Cottage Grove was charged with gross misdemeanor 3rd-degree DWI – BAC .08% or greater Jan. 31, 2023. According to court documents, New Ulm Police patrolman Andrew Kuester received a call at 7:24 p.m. Jan. 28, 2023 about an intoxicated male who came to the Brown County Jail. The caller indicated the man drove himself to jail.

Officer Kuester went to the jail and talked to a man identified as Bauer who agreed to talk after receiving a Miranda warning. Bauer said he was drinking the evening of Jan. 27, 2023 and his last drink was about 4:30 a.m. Ja. 28. Bauer said he had four vodkas mixed with Mountain Dew and drove from Cottage Grove to the Brown County Jail, should not have driven with alcohol in his system and was “buzzed.”

Officer Kuester could smell alcohol coming from Bauer’s breath and noticed other intoxication clues. A preliminary breath test showed a .173 alcohol concentration. A breath test at 8:01 p.m. provided a final breath test result of .19 alcohol concentration.

• Manuel Dominguez Jr., 24, Fulda, was charged with gross misdemeanor selling liquor to a person under age 21 Jan. 27, 2023. According to court documents, New Ulm Police were doing alcohol compliance checks Dec. 28, 2022 when both buyers entered Orale Authentic Mexican Tacos & More, 1627 S. Broadway and said they each ordered a Mango White Claw from the server, later identified as Manuel Dominguez Jr. He asked them for identification. The buyers said they left their IDs in the car and would get them. Dominguez said it was ok and bought two Mango White Claws to their table. Buyers said they needed to leave and gave him $20. Buyers gave law enforcement receipts showing $10.08 in change, making two White Claw beverages cost $9.92.

• Beverly J. Bean, 76, 57731 Fort Road, New Ulm, was charged with gross misdemeanor selling liquor to a person under age 21 Jan. 27, 2023. According to court documents, New Ulm Police conducted alcohol compliance checks Dec. 28, 2022 when a buyer entered Walmart Liquor Store and grabbed a bottle of Smirnoff Zero Sugar Infusions Watermelon and Mint Vodka. The buyer was allowed to buy it. The cashier never asked about age or ID. The receipt showed a $13.22 cost.

Police Officer Andrew Achman entered the store, made contact with the cashier, Bean, identified himself and said law enforcement just did an alcohol compliance check and she failed when to sold the bottle of alcohol to an underage buyer.
