Court Proceedings

Brown County District Court

• Two gross misdemeanor charges of violating a harassment restraining order were filed March 20, 2023 against Eric A. Miller, 42, 326 Center, New Ulm. A Zoom hearing was set for 8:30 a.m., Tuesday, April 25.

According to court documents, New Ulm Police Sgt. Aaron Widmark met with a woman at the Brown County Law Enforcement Center who wanted to report HRO (harassment restraining order) violations regarding Miller. She said he is supposed to exchange their two children in common at her residence so they can stay in the residence, but she often ends up having to bring the children to his residence.

The woman said when she dropped them off at 9 p.m., Feb. 18, 2023, Miller appeared behind her at the rear of her vehicle, which frightened her. She said Miller was emotional and talked of trying to email her and she didn’t answer.

The woman said the day before, a witness called her and said Miller told him and his fiance that he was going to kill the victim and that he thinks the HRO is a joke. The woman said Miller sent her two screen shots that were photos of their children, via text message at 6:41 p.m. Feb. 10, 2023 that violate the HRO.

Widmark read the HRO that stated Miller could not be within 50 yards of the woman’s residence and Miller can’t have direct contact or any social media contact other than 3 emails a day and may use his mother as a third party after the emails are sent.

The woman said she got a text snapshot from Miller on Feb. 18, 2023 and when she dropped her children off at Miller’s apartment, she expected him to stay in the house so he didn’t violate the HRO, but he came out to talk to her, which is a violation.

Miller was convicted of threats of violence Dec. 12, 2022 in Brown County Court.
