• Gross misdemeanor charges of third-degree DWI-refuse to submit to chemical test and driving after cancellation-inimical to public safety and misdemeanor fourth-degree DWI were filed June 22 against Steve K. Diener, 55, 2526 S. Bridge St. Bail without conditions was set at $12,000. A hearing was set for 8:30 a.m. July 6.

According to the complaint, New Ulm Police were near Hy-Vee Foods at 6:26 p.m. June 20 when a 2007 Toyota FJ Cruiser belonging to Diener, whose driving status is cancelled-inimical to public safety, was seen. Police saw him walk out of Hy-Vee, drive towards his residence, failing to use his turn signal as he turned onto S. Bridge St. from the Best Western parking lot.

Police smelled a faint odor of an alcoholic beverage coming from Diener’s breath while talking to him. He admitted to drinking several vodka and gingers earlier in the day. Police noticed intoxication clues from Diener. He provided a breath sample into a preliminary breath test that resulted in .212. Diener was arrested for DWI.

At the Brown County Jail, Diener refused to take a breath test. A breath test advisory was completed at 6:53 p.m.
