Bottom Fell Out of Jury Cases. Court Cases to Be Called for Trial Tuesday, June 17.

Judge I. M. Olsen denied a motion guilty of violating prohibition laws and sentenced to serve 30 days in the county jail and pay a fine of $150, at the opening of court, Monday morning. Following the denial of this motion, the court granted a stay of execution of the sentence until an appeal is taken to the state supreme court. Upson is at liberty under bonds until that time.

Bottom Drops Out of Calendar.

Following the motions in the Upson matter, the bottom fell out of the civil calendar. Cases were called for trial, but as attorneys were not ready to proceed or witnesses were not present in court, cases were either continued or dismissed and the members of the petit jury were discharged from further duty at this term of court.

Court Cases June 17.

The court informed attorneys that court cases would be tried as they appear on the calendar, beginning Tuesday, June 17. There is a desire to clean up the calendar and not have cases continued from one term to the next.

Berkner Cases.

In the case of Albert T. Penning,et al, vs. Ed. F. Berkner, tried Friday the jury awarded the plaintiff a verdict of $609. The case arose out of the alleged malicious cutting of trees upon the property of the plaintiffs by the defendant. Testimony was introduced that the defendant did not know where the property line was and that he thought the trees were upon his land. The plaintiffs claimed there were 68 trees cut down, while the defendant claimed there was a lesser number.

The next case tried was that of John Durr vs. Frank Guggisberg.The jury awarded the plaintiff $56.64.The suit arose out of a dispute over wages.

Monday morning the court ordered judgment in the action of Jos. Gabriel vs. Herbert Jeckell, et al. The defendant sued for a note of $500 and interest.

The action of A. N. Faas vs. Wm. A. Seifert was dismissed. This was an action over the drilling of a well. Settlement was announced in the action of Otto Wiedenmann vs. W.H. Covington, as in that of Peter Meyer vs. Henry R. Seifert, et al.

The plaintiff in the case of John A. Grabow vs. Joseph Ryan, not appearing in court the action was dismissed. The action of Andrew J. Gardner vs. Ben N. Zieske was also dismissed.

A continuance was noted in the action of Lizzie Schleif, et al, vs. Ed. F. Berkner, in the case of Henry Scheibel vs. Wm. Schreyer, and in the action of Roy Severns and Wm. Severns vs. S. A. Wooldrik.
