Check the full record on election lawsuits

To the editor:

I join the call for our local lawmakers to declare publicly that the election was fair and Joe Biden won. Rep. Hagedorn, Rep. Torkelson, and Sen. Dahms: Do the right thing. Be among the few courageous Republicans willing to speak the truth. I second Dan Beranek’s request for you to show leadership, and Thomas Kuster’s request for you to help your voters. You won’t be the first. Google Gabriel Sterling, Brad Raffensperger, and Brian Kemp.

In one of the election lawsuits entitled DONALD J. TRUMP FOR PRESIDENT, INC. et al, Petitioners, v. BUCKS COUNTY BOARD OF ELECTIONS, Defendant, DNC SERVICES CORP. / DEMOCRATIC NATIONAL COMMITTEE, Intervenor-Defendant, the Trump Campaign lawyers agreed in writing, and during a Nov. 17, 2020 hearing, to certain facts. Both sides agreed that the judge should make his decision based on those facts. Here are some of the paragraphs in the Stipulated Facts:

27. Petitioners do not allege, and there is no evidence of, any fraud in connection with the challenged ballots.

28. Petitioners do not allege, and there is no evidence of, any misconduct in connection with the challenged ballots.

33. Petitioners do not challenge the eligibility of the electors who cast the ballots at issue, and there is no evidence that any of the electors was ineligible to vote in the election.

34. Petitioners do not allege, and there is no evidence, that any of the challenged ballots were cast by, or on behalf of, a deceased person.

The judge, Robert O. Baldi, in his Nov. 19, 2020 written decision, denied the request of the Trump Campaign. In Pennsylvania, judicial elections are partisan and are held in odd years. Judge Baldi was appointed to the bench in July 2009 and later that year won election, as a Republican, to a ten year term.

On November 27, 2020, in the case of DONALD J. TRUMP FOR PRESIDENT, INC.; v. SECRETARY COMMONWEALTH OF PENNSYLVANIA, the U.S. Court of Appeals for the 3rd Circuit affirmed the decision of the lower court denying the relief requested by the Trump Campaign. The three federal judges who heard the case are David Brooks Smith and Michael Chagares, both appointed by President George W. Bush, and Stephanos Bibas, appointed by President Trump.

The information about these court cases and all the others is easily found online from numerous sources. You can read the documents submitted by both sides, and the opinions of the judges, state and federal, Republican and Democrat, liberal and conservative, who have denied the requests made by Mr. Trump.

Mary Thom asks “How many have listened to the unedited, sworn eyewitness accounts of corruption and fraud which have been given in Pennsylvania, Arizona, Michigan, Georgia, and Nevada in the past week?” May I suggest that after we read and listen to those accounts, we should also read the documents in the many failed Trump Campaign court cases. At the very least, go to foxnews.com, click on Politics, and read the reporting about those cases.
