Brown County Court

• Kathryn M. Armstrong, 43, Fridley, was convicted of misdemeanor leaving the scene of an accident and no insurance Monday. She received a statutory stay of adjudication for fifth-degree drug possession-no small amount of marijuana. Successful probation completion will result in a dismissal. Another fifth-degree drug possession charge plus possess/sale small amount of marijuana and possession of drug paraphernalia were dismissed.

For the conviction, she was sentenced to 90 days in the Brown County Jail, stayed for one year, fined $85 and sentenced to 40 hours Sentenced to Service (STS), within an indeterminate amount of time, concurrent with the stay of adjudication, can be done by STS or CWS.

For the stay, she was fined $1,075, can get credit towards fine up to the total amount of Chemical Dependency Assessment and any needed recommendations. She was placed on three years Supervised probation. Other conditions include no mood-altering chemicals including alcohol, except prescribed medications.

• Joshua A. Kotzer, 35, Benson, was convicted of felony first-degree burglary-assault person in building/on property. Second-degree burglary, gross misdemeanor domestic assault and misdemeanor domestic assault charges were dismissed. He was also convicted of felony fifth-degree drug possession-not small amount of marijuana. A possession of pharmacy hypodermic syringes/needles charge was dismissed. He was also convicted of felony receiving stolen property. Another receiving stolen property charge was dismissed.

For the first conviction, he was committed to the St. Cloud Correctional Facility for 68 months, stayed for 20 years. He was sentenced to 99 days in the Brown County Jail, credited with 99 days served and fined $1,585. Restitution open for 30 days. He was placed on 20 years Supervised probation. Conditions include no contact with victim(s), complete chemical use assessment and obtain mental health evaluation and follow recommendations. Do not use or possess firearms, ammunition or explosives, do not register to vote or vote until discharged from probation, pay restitution. He was Sentenced to Service for 80 hours within an indeterminate period of time.

For the second conviction, he was committed to the St. Cloud Correctional Facility for 13 months, stayed for five years. He was fined $85 and placed on five years Supervised probation.

For the third conviction, he was committed to the St. Cloud Correctional Facility for 12 months and one day, stayed for five years Supervised probation. He was fined $857.76 including $697.76 restitution.
