SE Council to consider cannabis use policy for city

SLEEPY EYE — The Sleepy Eye City Council will hold a special meeting in the council chambers beginning at noon, Wednesday, July 26.

The city council will consider adding an employee cannabis use policy to city personnel policy.

Employees with positions requiring a commercial driver’s license (CDL) are regulated by federal law which preempts state law related to cannabis use.

The Federal Department of Transportation (DOT) does not authorize the use of Schedule I drugs, including marijuana for any reason, according to the DOT Recreational Marijuana Notice. As a result, use of cannabis by employees required to hold a CDL for their employment is strictly prohibited. Such employees may be drug tested without notice. Any violations will result in corrective action, up to and including termination.

The city prohibits cannabis use for safety-sensitive positions including peace officers, firefighters, any position required face-to-face care, training, education, supervision, counseling, consultation or medical assistance to children, vulnerable adults and patients who receive health care services from a provider for the treatment, examination or emergency care of a medical, psychiatric, or mental condition.

In addition, a position funded by a federal grant or for which state or federal law requires testing a job applicant or employee for cannabis. In addition, a position requiring a CDL or employee to operate a motor vehicle for which state or federal law requires drug or alcohol testing of a job applicant or employee.

Agenda items include consideration of a second reading of Ordinance 218 to sell property, Lot 14, Block 1 of the Snow Second Addition, for $25,000 to Marie Bushard.
