ATV drivers face felony charges
Accused of fleeing police,
reckless driving
SLEEPY EYE — Two Sleepy Eye men and one New Ulm man face felony fleeing a peace officer in a motor vehicle and gross misdemeanor reckless driving charges after a late night pursuit in and south of Sleepy Ey April 27, 2023.
Charges were filed June 29, 2023 in Brown County District Court against Nixon J. Hillesheim, 26, 130 4th Ave. N.E.; Kyle M. Fischer, 21, 25455 170th Street; and Ryan B. Kuck, 24, 16995 CR 27, New Ulm.
An arraignment for Hillesheim was set for 8:30 a.m., Monday, July 24. Court appearances for Fischer and Kuck begin at 8:30 a.m. July 25.
According to court documents, Sleepy Eye Police Officer McGarry was on routine patrol with officer Bolinger April 27, 2023, traveling eastbound on Maple Street S.E. when they noticed three ATVs ahead of them.
The ATVs appeared to be traveling quickly when they turned north onto 12th Ave. S.E.. One of the ATVs accelerated extremely quickly, appearing to go faster than the posted 30 mph speed limit, and did a wheelie.
Officer McGarry activated his emergency lights as he approached the intersection of Maple St. S.E. and 12th Ave. S.E.. The ATVs turned into the Kibble Equipment parking lot and continued at a high rate of speed.
Officer McGarry turned into the parking lot and activated his squad siren. The ATVs left the parking lot on the east side and went south on 260th Avenue, accelerating quickly. Officer McGarry drove through the parking lot and followed the ATVs south.
Reaching speeds of about 65 mph on the gravel road, trying to catch the ATVs that swerved back and forth in the road ahead of McGarry continued following the ATVs with his lights and sirens activated. The pursuit lasted for about a mile south of the parking lot. The ATV drivers were identified as Nixon John Hillesheim, Ryan Bruce Kuck and Kyle Mitchell Fischer.
