AN ORDINANCE
AMENDING
CHAPTER 8 OF THE
CITY CODE OF THE
CITY OF NEW ULM
RELATIVE TO
PENALTIES FOR
COMMITTING OR
PERMITTING A PUB-
LIC NUISANCE.
BE IT ORDAINED BY
THE CITY COUNCIL
OF THE CITY OF
NEW ULM:
SECTION I. That
Chapter 8 of the City
Code of the City of
New Ulm, Minnesota,
is hereby amended by
adding the following
new Section, to read
as follows:
Section 8. 47. Penal-
ty. It shall be a mis-
demeanor offense for
any person to violate
the provisions of Sec-
tion 8. 45 and 8. 46
described above. A
conviction for such vio-
lation shall result in a
minimum sentence
under the following
schedule.
1. For a first offense
within a twelve- month
period, a fine of $100.
00.
2. For a second of-
fense within a
twelve-month period, a
fine of $300. 00.
3. For a third or greater
offense within a
twelve- month period, a
fine of $500. 00.
For purposes of deter-
mining the minimum
sentence, the date of
the offense, not the
date of the conviction,
shall be the operative
date.
SECTION II. That this
ordinance shall take ef-
fect and shall be in
force 30 days from and
after its adoption, ap-
proval, and publication.
