ORDER AND NOTICE OF HEARING ON PETITION FOR FORMAL PROBATE OF WILL AND APPOINTMENT OF PERSONAL REPRESENTATIVE AND NOTICE TO CREDITORS

It is Ordered and Notice is given that on the 13th day of May, 2019, at 9:00 o’clock a.m., a hearing will be held in this Court at the Brown County Court House, 14 South State Street, New Ulm, MN 56073, for the formal probate of an instrument purporting to be the Will of the Decedent, dated January 28, 1992, and for the appointment of Harold John Apitz, Jr., whose address is 11 Bishop Lucker Lane, New Ulm, MN 56073 and Lisa Margaret Apitz, whose address is 104 Jaybee Lane, Mankato, MN 56001 as co-personal representatives of the Estate of the above-named decedent in an unsupervised administration.

Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper, and no objections are filed or raised, the Co-Personal Representatives will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.

Notice is also given that, subject to Minn. Stat. 524.3-801, all creditors having claims against said Estate are required to present the claims to the Personal Representative or to the Court Administrator within four (4) months after the date of this Notice or the claims will be barred.

WHEREAS, Douglas and Sally Foster have filed an application with the City of New Ulm requesting a variance to allow a fence to be located 0′ from the side property line on property legally described as the Rear ¢ of Lot 7, Block 31 North of Center Street. The required setback is 5′. The street address of the property is 211 9th North Street; and

WHEREAS, Darren Zieske has filed an application with the City of New Ulm requesting a variance to reduce the size of the setback on the rear and side of the property from 10′ to 5′ on the parcel of property legally described as Lot 10, Block 5, Country Club Addition. The street address of the property is 1721 Southridge Road; and

WHEREAS, the City Code requires that these matters be considered by the New Ulm Planning Commission.

NOW, THEREFORE, BE IT RESOLVED, pursuant to the City Code, the New Ulm Planning Commission will meet at 4:30 P.M. on Thursday, April 25, 2019 in the City Hall Council Chambers, 100 North Broadway, New Ulm, Minnesota to consider these matters. The public and all interested parties are hereby officially notified of said hearings.
