Court Proceedings

Brown County District Court

• Gross misdemeanor 3rd-degree DWI-test refusal and misdemeanor 4th-degree DWI charges were filed Nov. 30, 2022 against Simon L. Lindberg, 36, 326 E. Walnut St., Mankato. On Oct. 28, 2022 at 2:22 a.m., New Ulm Police Officer Tyler Forrest was on patrol near Minnesota Street N. and 7th North Street when he saw a maroon Chevrolet Silverado take a wide turn from Minnesota Street onto 7th North, crossing out of its lane of travel. Officer Forrest saw the vehicle travel about half a block with both passenger side tires over the fog line before moving back into its lane of travel.

Officer Forrest stopped the vehicle, identified the driver as Lindberg and noticed intoxication clues. He denied drinking and refused to comply with field sobriety tests. He later admitted to drinking three beers and provided a preliminary breath test that showed a .205 alcohol concentration.

Lindberg was arrested. At the Brown County Jail, he refused to submit to a breath test, saying it was not needed.

• Two felony 3rd-degree drug possession-methamphetamine/amphetamine in school/park/public housing zone charges, felony 5th-degree drug possession-not small amount marijuana and gross misdemeanor 5th-degree drug possession-not small amount marijuana charges were filed Nov. 30, 2022 against Jennifer L. Volk, 46, New Ulm.

According to court documents, New Ulm Police Officer Tyler Forrest was on patrol on Oct. 9, 2022 when noticed a vehicle due to the smell of burnt marijuana coming from it. He followed the vehicle and saw it drive down the middle of State Street N.

Forrest stopped the vehicle next to Washington Park and noticed many air fresheners in the vehicle and the driver, Volk, had a perfume bottle in her lap. Searching the vehicle, Officer Forrest was handed a small, plastic bag with a leafy, green substance inside which he recognized as marijuana.

Officer Forrest also found a glass pipe with what appeared to be meth residue inside, a clear pill bottle with three different types of pills, a single Adderall time-release capsule, two white dextromphetamine pills and three blue amphetamine/dextroamphetamine pills. The marijuana tested positive for THC. The glass pipe tested positive for methamphetamine.
