Brown County District Court

• Third-degree gross misdemeanor DWI and fourth-degree misdemeanor DWI charges were filed Nov. 28 against Jodi L. Gartner, 48, Edina.

According to court documents, New Ulm Police Patrolman Erik Byro was on patrol near 2nd North Street and Broadway at 1:11 a.m. Oct. 9, 2022 when he noticed a grey Mazda that appeared to be driving faster than the 30 mph posted speed limit. Radar showed the vehicle traveling at 45 mph. Officer Byro stopped the suspect vehicle near 3rd St. S. and State St.

The driver was identified as Gartner. A strong odor of alcohol came from the vehicle and Gartner showed intoxication clues. A preliminary breath test showed a .174 alcohol concentration.

Gartner was arrested and taken to the Brown County Jail. A DMT breath test at 2:14 a.m. resulted in a .15 alcohol concentration. Gartner was convicted of DWI Feb. 25, 2015 in Ramsey County Court.
