Court Proceedings

Brown Count

District Court

• Andrew R. Sears, 32, 400 State St. S., New Ulm, was charged with two counts of gross misdemeanor third-degree DWI and misdemeanor driving after suspension Aug. 6. According to court documents, New Ulm Police were on patrol at 4 a.m., Aug. 6 when their attention was drawn to a vehicle traveling on 7th North Street near German Street. A routine license plate check indicated the registered owner, Sears, had an active warrant. Police stopped the vehicle and identified the owner as Sears.

Police detected a strong alcoholic beverage odor coming from Sears and took him to the Brown County Law Enforcement Center. He denied drinking but failed certain field sobriety tests. He did not perform a preliminary breath test properly and was arrested for DWI. A breath sample taken at 5:12 a.m. read .13 grams per 210 liters of breath.

Sears’ driving record indicated a qualified, prior impaired driving conviction on Oct. 15, 2018 for operating under the influence in Iowa. A driver’s license check indicated his status was suspended.
