• Jennifer R. Bernier, 29, 21810 CR 20, Hanska, was charged Monday with gross misdemeanor third-degree DWI, DWI 0.08 within 2 hours, misdemeanor littering-dangerous object on highway and petty misdemeanor speeding.

According to court documents, Minnesota State Patrol trooper Scott Kuphal observed a vehicle that appeared to be traveling faster than 55 mph on Brown CR 27 in Milford Township, Brown County at 12:10 a.m., Aug. 1. Kuphal activated his radar and obtained a 70 mph speed reading on the vehicle.

Kuphal pulled the vehicle over near the CR 11 intersection and identified the driver as Bernier, who displayed intoxication clues. Bernier flicked cigarette ashes outside the vehicle window and admitted to drinking. She failed certain field sobriety tests and provided a preliminary breath test that resulted in .154. A breath sample provided at 1:27 a.m. read 0.12.

Bernier was convicted of operating a motor vehicle while under the influence of an intoxicant on May 7, 2013, which is a qualified, prior, impaired driving offense within 10 years immediately proceeding the offense. A bail hearing was set for 11:30 a.m. Tuesday on Zoom.
