Court Proceedings

Brown County Court

Daniel L. Hoffman, 58, 37829 521st Ave., New Ulm, was charged with two counts of 3rd-degree gross misdemeanor DWI in Brown County District Court Monday.

According to court documents, New Ulm Police got an anonymous complaint on Sunday, April 26 regarding a man who exited Minnecon Park, 2 Minnecon Drive that appeared to be intoxicated. The caller said the man was in a Ford F-150 with dealer plates.

The caller said the man exited a boat, slipped and fell multiple times, got to the truck, was sitting on the tailgate and almost fell over while sitting in it, then backed the truck into the boat ramp.

Officer Erik Byro arrived at Minnecon Park, located the described vehicle near the boat ramp, and observed the man identified as Hoffman and detected a strong, alcoholic odor coming from him. Hoffman admitted drinking and failed a horizontal gaze nystagmus field sobriety test and a preliminary breath test. He was arrested for DUI.

Hoffman provided a breath sample for analysis at 6:48 p.m. Sunday that showed an alcohol concentration of .19 frams per 210 liters of breath. He said multiple times that he only moved the vehicle to the boat launch.
