• Damian M. Rivera, 29, 216 Walnut St. S.W., Sleepy Eye, was charged with two counts of gross misdemeanor second-degree DWI Monday. According to court documents, Sleepy Eye Police were informed at 8:55 p.m., Dec. 20 of a driving complaint that originated in New Ulm but other officers were out of position or busy.

Dispatch said a caller said he was being tailgated by a vehicle on Highway 14, 7th St. North in New Ulm, then passed the caller on Broadway at a high rate of speed, about 70 mph. and did not navigate a roundabout near Menard’s well.

Sleepy Eye Police drove towards New Ulm and met a vehicle that appeared to be traveling more than 60 mph and matched the description. Police used radar that indicated the suspect vehicle was traveling at 64 mph, weaved in the traffic lane, touching the centerline. Police stopped the vehicle and identified the driver as Rivera who displayed intoxication clues. He failed certain field sobriety tests. A breath sample registered .145 BAC at 9:17 p.m., and .12 at 10:09 p.m.

Rivera had two prior DWI convictions on April 3, 2012 and Jan. 27, 2015; and was booked.
