• Brian M. Peters, 38, of 1125 S. Minnesota St., New Ulm, was charged Aug. 20 with gross misdemeanor 3rd-degree refusal to submit to chemical test, misdemeanor 4th-degree DWI, driving after suspension, drug possession more than 1.4 grams marijuana in motor vehicle and petty misdemeanor possession of drug paraphernalia.

According to court documents, New Ulm Police were on patrol near 20th South and Valley at 9:27 p.m., Aug. 17 when a Jeep Grand Cherokee driven by a driver with a suspended license, passed them. Peters told police he lost his license, then admitted it was suspended. In addition, he showed signs of intoxication and admitted drinking. He refused to take a breath and chemical test.

Police observed cans of beer and a glass pipe commonly used to smoke marijuana in Peters’ vehicle. The pipe smelled of burned marijuana. Police found a baggie with a small amount of a leafy substance that smelled and looked like marijuana that weighed 3.3 grams.
