NEW ULM -- A 44-year-old Pemberton man involved in an October 2022 crash at 3rd North and Broadway that seriously injured two people was sentenced to five years supervised probation and 150 days in jail in Brown County District Court June 12.
Miguel Bustillos was convicted of amended felony criminal vehicular operation-great bodily harm, alcohol .08 or more within 2 hours of driving and amended felony threats of violence-reckless disregard risk.
Eight counts including four felony criminal vehicular operation-great bodily harm counts, felony criminal vehicular operation-substantial bodily harm, amended gross misdemeanor DWI; driver must carry proof of insurance when operating vehicle, possession of over 1.4 grams marijuana in motor vehicle and fleeing a peace officer by means other than a motor vehicle were dismissed.
A 23 month sentence at the St. Cloud Correctional Facility was stayed for 5 years probation. Bustillos was fined $1,000, can be worked off by Sentence To Service hours if available. Brown County Jail time will be served by staggered sentence beginning July 1, 2023.
According to court documents, the injured victims had brain bleeds and were placed in intensive care but did survive the crash.
Several witnesses recounted the crash to law enforcement, saying a 2005 Buick Le Sabre was traveling westbound on 3rd North at a high rate of speed, running a stop sign before turning onto Broadway, hitting a 2001 Oldsmobile Alero that was northbound on the 200 block of North Broadway.
A witness said Buick had heavy front-end damage in the crash before two individuals exited the car and ran south. One of the witnesses caught one of the individuals and escorted him back to the crash.
Another witness told Brown County dispatch the unidentified party who fled on foot was near Center and Washington Street. A short time later, Brown County Sheriff's Deputy Jeremy Reed located, stopped and identified the individual as Bustillos with intoxication clues.
In addition, Bustillos made threatening comments to law enforcement. He admitted to consuming three or four beers prior to the crash. A green, leafy substance found in the Buick NIK tested positive for THC and weighed about 13.4 grams.
