NU man resists arrest at Broadway Haus

Faces four charges after fight with police

NEW ULM — A 29-year-old New Ulm man who resisted arrest at the Broadway Haus March 23, faces four charges, including two counts of physically assaulting a peace officer. Charges were filed Thursday in Brown County District Court.

Two counts of gross misdemeanor fourth-degree assault, gross misdemeanor obstructing legal process and misdemeanor obstructing legal process were filed March 25 against Daniel P. Orlawski, 300 N. Broadway, New Ulm. An initial court appearance was set for 8:30 a.m., April 6.

Orlawski posted $1,000 bail with conditions including no alcohol/controlled substance use.

According to court documents, New Ulm Police attempted to execute a search warrant at the Broadway Haus, 300 N. Broadway, New Ulm, at 6:26 p.m. March 23. Officers were informed that Orlawsky was possibly mentally unstable and had been known to be violent towards law enforcement.

Police would not say what the search was for, citing an ongoing investigation.

Officers knocked on the Orlawsky’s door and identified themselves as New Ulm Police with a search warrant and he opened the door. Police asked him to cooperate with a pat search for weapons.

A verbal confrontation quickly escalated with Orlawsky yelling, clenching his fists and telling police to leave.

Police explained that they had a search warrant for Orlawsky’s residence. He responded that they were not the real police, that the only police were military police; that they were in Blue Earth County, that the CIA and FBI were coming, and that it wasn’t a valid arrest.

Police decided to take Orlawsky into custody based on his behavior, and for his safety and the safety officers.

Officers tried to arrest Orlawsky and he physically resisted. Police noticed a large machete behind a door they were next to while trying to talk to Orlawsky.

An attempt to tase Orlawsky was ineffective. As one of the officers tried to take him to the ground he felt something strike him on the back of his head. Body camera footage showed Orlawsky hit the officer in the back of the head with his elbow.

As one officer backed up, Orlawsky swung at him, trying to hit him in the head, then hit another officer in the mouth, drawing blood inside his mask and cutting his lip.

After Orlawsky was handcuffed, he tried to reach for an officer’s duty weapon and continued to make illogical statements.

Orlawsky was transported to the New Ulm Medical Center emergency room to remove taser probes. He continued to state that he “was a soldier, that the CIA and military police were going to kill the officers; and that the officers should call the president.”

One of the officers had red marks and scrapes to his left and right arms from the incident.
