The above-entitled matter came on for hearing before the Judge of District Court on November 16, 2016, at the Goodhue County Government Center, Read Wing, Minnesota. The Petitioner appeared personally and with her attorney, Nicole R. Broderick. The Respondent and Co-Respondent did not appear at the hearing.

Based on the above, the Court makes the following

WHEREAS, Respondent and Co-Respondent are the parents of minor child, namely:

Patrick Kevin Nachreiner, d/o/b: 11/26/2011.

WHEREAS, the above-named Petitioner is the maternal grandmother of the minor child of Respondent and Co-Respondent.

WHEREAS, pursuant to Stipulation and Order dated September 26, 2014 Petitioner has temporary legal and temporary physical custody of the minor child, subject to supervised parenting time by Respondent. Co-Respondent’s parenting time is reserved.

WHEREAS, the minor child has resided exclusively with Petitioner since 2014.

WHEREAS, Respondent has been having supervised parenting time with the minor child two days per week in Petitioner’s home.

WHEREAS, Co-Respondent has not had parenting time with the minor child since March 2014.

WHEREAS, Petitioner is represented by Nicole R. Broderick, Gorman & Broderick, PLC, 120 East Avenue, Red Wing MN 55066. Respondent and C0-Respondent are pro se.

WHEREAS, Petitioner resides at 9355 County 9 Blvd, Cannon Falls, MN 55009,

WHEREAS, Respondent resides at; Unknown

WHEREAS, Co-Respondent resides at; 1513 North Payne Street, A2 #8, New Ulm, MN 56073;

WHEREAS, the minor child is attached to Petitioner and adjusted to being in the care and home of Petitioner.

WHEREAS, the minor child has thrived while in the care of Petitioner,

WHEREAS, it is in the best interest of the minor child that Petitioner be granted permanent legal and permenant physical custody of the minor child, subject to supervised Parenting time by the Respondent.

WHEREAS, Respondent signed a Stipulation and Order awarding Petitioner permanent custody. Co-Respondent did not respond when Petitioner sent said order to Co-Respondent. There was no appearance by Co-Respondent.

NOW THEREFORE, the parties agree and the Court Orders the following:

1. Custody: Petitioner is awarded permanent legal and Permanent physical custody of the minor child, namely: Patrick Kevin Nachreiner, d/c/b; November 26, 2011.

2. Parenting Time: Respondent is awarded supervised parenting time at the discretion of Petitioner.

3. Co-Respondent’s parenting time is reserved.

4. Unless specifically address, the terms and conditions of the order dated September 30, 2014 and any child support orders shall remain in full service and effect.

5. That Apendix A is attached hereto, and made apart hereof.
