RECEIPT AND OPENING OF PROPOSALS: Sealed proposals for the work described below will be received at the Office of the City Finance Director, City of New Ulm, 100 North Broadway, New Ulm, Minnesota 56073-0636 until 10:00 a.m. on Wednesday, April 5, 2023, at which time the bids will be opened and publicly read.

DESCRIPTION OF WORK: The work includes the construction of approximately: FULL DEPTH RECLAMATION – 23,250 SQ YD

MILL BITUMINOUS SURFACE (2.0″) – 29,069 SQ YD

TYPE SP 9.5 WEARING COURSE MIXTURE (3,B) – 3,977 TON

TYPE SP 9.5 WEARING COURSE MIXTURE (3,C) – 5,487 TON

TYPE SP 12.5 NON WEARING COURSE MIXTURE (3,B) – 2,744 TON

CONCRETE WALK – 9,207 SQ FT

CONCRETE CURB AND GUTTER – 1,633 LIN FT

together with numerous related items of work, all in accordance with Plans and Specifications. This project is subject to Prevailing Wage Rates, Truck Rentals, Equal Employment Opportunity Provisions, Buy American Iron and Steel Provisions, and Responsible Contractor Certification.

Minimum wage rates to be paid by the Contractors have been predetermined and are subject to the Work Hours Act of 1962, P.L. 87-581 and implementing regulations.

The Minnesota Department of Transportation hereby notifies all bidders:

in accordance with Title VI of the Civil Rights Act of 1964 (Act), as amended and Title 49, Code of Federal Regulations, Subtitle A Part 21, Non-discrimination in Federally-assisted programs of the Department of Transportation, it will affirmatively assure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded maximum opportunity to participate and/or to submit bids in response to this invitation, and will not be discriminated against on the grounds of race, color, disability, age, sex or national origin in consideration for an award;

“It is hereby agreed between the parties that Minnesota Statute, section 363A.36 and Minnesota Rules, parts 5000.3400 to 5000.3600 are incorporated into any contract between these parties based on this specification or any modification of it. A copy of Minnesota Statute 363A.36 and Minnesota Rules, parts 5000.3400 to 5000.3600 is available upon request from the contracting agency.”

“It is hereby agreed between the parties that this agency will require affirmative action requirements be met by contractors in relation to Minnesota Statute 363A.36 and Minnesota Rules 5000.3600. Failure by a contractor to implement an affirmative action plan or make a good faith effort shall result in revocation of its certificate or revocation of the contract (Minnesota Statute 363A.36, Subd. 2 and 3).”

A minimum goal of 9.5% Good Faith Effort to be subcontracted to Disadvantaged Business Enterprises.

COMPLETION OF WORK: All work under the Contract must be complete by 10/31/2023.

BID SUBMITTAL A Bid shall be submitted no later than the date and time prescribed. Prospective bidders must be on the plan holders list through QuestCDN for bids to be accepted.

PROPOSAL GUARANTY: A Proposal Bond in the amount of not less than 5 percent of the total amount bid, drawn in favor of the City of New Ulm shall accompany each bid.

OWNER’S RIGHTS RESERVED: The Owner reserves the right to reject any or all bids and to waive any irregularities and informalities therein and to award the Contract to other than the lowest bidder if, in their discretion, the interest of the Owner would be best served thereby.
