NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN, that the City Council of the City of New Ulm, Brown County, Minnesota will meet in the Council Chambers in the New Ulm City Hall on Tues-day, February 7, 2023 at 4:30 p.m. to consid-er ordering in the following improvements:

2023 UTILITY, STREET AND ALLEY IMPROVEMENTS – GROUP I

1. Washington Street from 7th South Street to 10th South Street. Reconstruction of the existing watermain, sanitary sewer main, sewer and water end services, storm sewer extension and modifi-cation, and reconstruction of the existing roadway section in-cluding excavation and replacement of subgrade, aggregate base, bituminous pav-ing, pavement sub-drains, concrete curb and gutter, pedestrian sidewalk ramps, street lighting and selective replacement of con-crete driveway pave-ment and sidewalk.

2. Minnesota Street from 7th North Street to 9th North Street. Reconstruction of the existing watermain, sanitary sewer main, sewer and water end services, storm sewer extension and modifi-cation, and reconstruc-tion of the existing roadway section in-cluding excavation and replacement of subgrade, aggregate base, bituminous pav-ing, pavement sub-drains, concrete curb and gutter, pedestrian sidewalk ramps, street lighting and selective replacement of con-crete driveway pave-ment and sidewalk.

3. Oakwood Avenue from Boettger Road to Milford Street. Recon-struction of the existing roadway section in-cluding excavation and replacement of subgrade, aggregate base, bituminous pav-ing, pavement sub-drains, selective re-placement of concrete curb & gutter, pedestri-an sidewalk ramps and selective replacement of concrete driveway pavement and side-walk.

4. Alley Block 97 South of Center Street. Alley from 8th South Street to 9th South Street. between Broadway and State Street. This project consists of the reconstruction of the existing alley pave-ment section including grading, aggregate base, bituminous sur-facing, selective seven inch (7″) concrete alley approach pavement, underdrain, miscellane-ous removals and res-toration.

5. Alley Block 96 South of Center Street. Alley from 9th South Street to 10th South Street between Broadway and State Street. This project consists of the reconstruction of the existing alley pave-ment section including grading, aggregate base, bituminous sur-facing, selective seven inch (7″) concrete alley approach pavement, underdrain, miscellane-ous removals and res-toration.

6. Alley Block 93 South of Center Street. Alley from 12th South Street to 13th South Street between Broadway and State Street. This project consists of the reconstruction of the existing alley pave-ment section including grading, aggregate base, bituminous sur-facing, selective seven inch (7″) concrete alley approach pavement, underdrain, miscellane-ous removals and res-toration.

7. Miscellaneous Storm Sewer, Con-crete Sidewalk and ADA Improvements. ADA pedestrian ramp improvements to com-pliment the improve-ments scheduled within the 2023 Sur-face Reconstruction Project to meet the current ADA require-ments as per New Ulm’s adopted ADA Transition Plan and other deficient concrete sidewalk at locations determined by the City Engineer.

pursuant to Minnesota Statutes, Sections 429.011 to 429.111. The area proposed to be assessed for such improvements is each lot, piece and parcel of property specially benefited by said im-provements. A reason-able estimate of the impact of the assess-ment will be available at the hearing. The to-tal estimated cost of the 2023 UTILITY, STREET AND ALLEY IMPROVEMENTS – GROUP I project is $3,382,830.00. Such persons as desired to be heard with refer-ence to the proposed improvements will be heard at this meeting.

NOTICE AND ORDER OF HEARING ON PETITION FOR PRO-BATE OF WILL AND APPOINTMENT OF CO-PERSONAL REPRESENTATIVES AND NOTICE TO CREDITORS

It is Ordered and No-tice is given that on February 22, 2023 at 9:05 a.m., a hearing will be held in this Court at 14 South State Street, New Ulm, Minnesota, for the for-mal probate of an in-strument purporting to be the Will of the De-cedent dated, April 3, 2015 (“Will”), and for the appointment of Daniel Steffl, whose address is 117 Lookout Lane, New Ulm MN 56073, and Terese An-dersen, whose address is 8561 East Haverhill Lane, Tucson AZ 85715, as Co-Personal Representatives of the Estate of the Decedent in an unsupervised ad-ministration. Any ob-jections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Co-Personal Representatives will be appointed with full power to administer the Estate including the power to collect all as-sets, to pay all legal debts, claims, taxes and expenses, to sell real and personal pro-perty, and to do all necessary acts for the Estate.

Notice is also given that (subject to Min-nesota Statutes section 524.3-801) all creditors having claims against the Estate are required to present the claims to the Co-Personal Representatives or to the Court Administrator within four months after the date of this Notice or the claims will be barred.
