NOTICE IS HEREBY

given that the City

Council will hold a pub-

lic hearing on Tuesday,

October 18, 2022 at

4:30 p.m. at the Coun-

cil Chambers in City

Hall, 100 North Broad-

way in the City of New

Ulm, Minnesota, and

consider adoption of

the final special as-

sessment prepared by

the City Manager to

defray the cost of the

following improve-

ments:

FINAL ASSESSMENT

ROLL FOR THE 2021

UTILITY, STREET

AND ALLEY IM-

PROVEMENTS –

GROUP I

The improvements

constructed on this

project are as follows:

1. Jefferson Street

from 7th North Street

to 12th North Street.

This project consists of

the

reconstruction of the

existing watermain,

sanitary sewer main,

sewer and water end

services and recon-

struction of the existing

roadway section in-

cluding excavation and

replacement of

subgrade, aggregate

base, bituminous pav-

ing, pavement sub-

drains, storm sewer ex-

tension and inlet struc-

ture reconstruction,

concrete curb and

gutter, pedestrian

sidewalk ramps, street

lighting and selective

replacement of con-

crete driveway pave-

ment and sidewalk.

2. Washington Street

from 4th North Street

to 5th North Street.

This project consists of

the

reconstruction of the

existing watermain,

sanitary sewer main,

sewer and water end

services and recon-

struction of the existing

roadway section in-

cluding excavation and

replacement of

subgrade, aggregate

base, bituminous pav-

ing, pavement sub-

drains, storm sewer

modification and inlet

structure reconstruc-

tion, concrete curb and

gutter, pedestrian

sidewalk ramps, street

lighting and selective

replacement of con-

crete driveway pave-

ment and sidewalk.

3. State Street from

16th South Street to

17th South Street. This

project consists of the

extension of watermain

and sanitary sewer

main.

4. Maplewood Drive

from Red Bud Road to

Ryan Road. This pro-

ject consists of water-

main extension, sewer

and water end ser-

vices, grading, aggre-

gate base, bituminous

base,

concrete curb and

gutter, concrete side-

walk, concrete drive-

way pavement, bitumi-

nous surfacing,

boulevard trees,

boulevard restoration

and street lighting.

5. 20th North Street

Tree Clearing. This

project consists of tree

removal in the antici-

pated construction lim-

its for the 2022 20th

North Street construc-

tion project.

6. Alley Block 189

North of Center Street.

Alley from 7th North

Street to 8th North

Street between Garden

Street and Payne

Street. This project

consists of the recon-

struction of the

existing alley pave-

ment section including

grading, aggregate

base, bituminous sur-

facing, seven inch (7″)

concrete alley ap-

proach pavement, un-

derdrain, miscellane-

ous removals and res-

toration.

7. Alley Block 191

North of Center Street.

Alley from 9th North

Street to 10th North

Street between Garden

Street and Payne

Street. This project

consists of the recon-

struction of the

existing alley pave-

ment section including

grading, aggregate

base, bituminous sur-

facing, seven inch (7″)

concrete alley ap-

proach pavement, un-

derdrain, miscellane-

ous removals and res-

toration.

8. Cottonwood River

Outfall O-C-23 Repair.

This project consists of

repairing a damaged

storm sewer outfall and

stabilizing the river-

bank at the outfall.

9. Concrete Sidewalk

and ADA Improve-

ments. This project

consists of ADA

pedestrian ramp

improvements to com-

pliment the improve-

ments scheduled

within the 2021 Sur-

face Reconstruction

Project to meet the

current ADA require-

ments as per New

Ulm’s adopted

ADA Transition Plan.

The proposed assess-

ment rolls are on file

for public inspection at

the City Finance

Director’s

office.

Written or oral objec-

tions will be considered

at the public hearing.

No appeal may be tak-

en as to the amount of

an assessment unless

a signed, written objec-

tion is filed with the Fi-

nance Director

prior to the hearing or

presented to the

presiding officer at the

hearing.

After the public hearing

the City Council may

adopt the proposed

special assessment

roll. You

will have 30 days from

the adoption date to

pay the entire final spe-

cial assessment without interest to the

Brown County

Auditor-Treasurer’s Of-

fice. After such time,

you may pay

to the County Auditor

the entire amount of

the assessment

remaining unpaid, plus

the interest accrued to

December 31st of the

year in which such

payment is made.

Such payment to the

County must be made

before November 15th

or interest will be

charged through De-

cember 31st

of the succeeding year.

The unpaid balance of

any assessment will be

levied by Brown Coun-

ty

and will be collected as

an assessment on your

property tax statement

over a ten (10) year

period along with a

2.60% percent simple

interest charge on the

unpaid balance.

An owner may appeal

an assessment to dis-

trict court pursuant to

Minnesota Statutes

Section 429.081 by

serving notice of the

appeal upon the Mayor

or Finance Director of

the of the City within 30

days after the adoption

of the assessment and

filing such notice with

the district court within

ten days after service

upon the Mayor or Fi-

nance Director.

Under Minnesota Sta-

tutes 435.193 to

435.195 the Council

may, in its discretion,

defer the payment of

this special assess-

ment for any home-

stead property owned

by a person 65 years

of age or older for

whom it would be a

hardship to make these

payments. When

deferment of the

special assessment

has been granted and

is terminated for any

reason provided by

law, all amounts accu-

mulated plus applica-

ble interest become

due. Any assessed

property owner meet-

ing the requirements of

this law and City Code

Section 2.80 adopted

under it may, within 30

days of the confirma-

tion of the assessment

apply to the Finance

Director on such forms

as are

prescribed by the

County Auditor for

such deferral of pay-

ment of this special as-

sessment on his

property.
