SECTION 1. That the
City Charter for the
City of New Ulm, Sec-
tion 22, Boards, Com-
missions, and Depart-
ments, is hereby
amended as follows

Section 22. Boards,
Commissions, and
Departments. In addi-
tion to the elective offi-
cials of the City, there
shall be a Board of
Health, a Public Utili-
ties Commission, a
Fire Department, a Hu-
man Rights Commis-
sion, and a Police
Commission, the du-
ties, powers, and form
of organization of
which shall be as de-
fined herein. There
shall also be the fol-
lowing Departments:
Fire Department, Pol-
ice Department, En-
gineering Department,
Human Resources
Department and Finan-
cial Departments. The
City Council may es-
tablish by ordinance
such additional depart-
ments, boards and
commissions as it
deems appropriate.

SECTION 1. That the
City Charter for the
City of New Ulm, Sec-
tion 24, Incompatible
Offices, is hereby
amended as follows

Section 24. Incompati-
ble Offices. Neither the
Mayor nor any member
of the City Council, nor
any immediate family
member of such offi-
cial, or Public Utilities
Commission (a “local
official”) shall hold any
paid municipal office or
employment under the
City; and, until one
year after the expira-
tion of that person’s
term of office as Mayor
or Councilor, such
former official may not
be appointed to any
paid office or employ-
ment under the City
that was created during
that person’s term or
the compensation for
which was increased
during said term, nor
shall they influence or
attempt to influence the
hiring, transfer,
suspension, promotion,
discharge, reward, dis-
cipline or the adjust-
ment of grievances of
a related person.
“Related person” shall
mean a person in a
marital relationship, a
domestic partner rela-
tionship or other com-
mitted relationship with
a local official, or in a
significant familial rela-
tionship with a local of-
ficial.
“Significant familial re-
lationship” means:
(1) By blood or adop-
tion: parent, child,
grandparent,
grandchild, brother,
sister, half-brother,
half-sister, uncle, aunt,
nephew, niece, first
cousin.
(2) By marriage: hus-
band, wife, stepparent,
stepchild, stepbrother,
stepsister,
brother-in-law,
sister-in-law,
father-in-law,
mother-in-law,
son-in-law,
daughter-in-law, uncle,
aunt, nephew, niece.
Divorce or death of a
spouse terminates a
significant familial rela-
tionship by marriage.

ORDAINS:
SECTION 1. That the
City Charter for the
City of New Ulm is
hereby amended to
add a new section,
Section 39, Conflicts of
Interest, as follows:
Section 39. Conflicts
of Interest. A conflict
of interest is present
when an elected or ap-
pointed official, in the
discharge of that
official’s official duties,
would be required to
take an action or make
a decision regarding a
matter in which the offi-
cial has a personal
financial interest, or is
otherwise so personal-
ly interested in such
matter that the official
cannot act in the public
interest. For purposes
of this section, a per-
sonal financial interest
is any interest which
shall yield, directly or
indirectly, a material
monetary or other
benefit to the official,
excluding such cir-
cumstances when the
official’s financial in-
terest is no greater
than that of another
member of the official’s
business classification,
profession or occupa-
tion.
Any elected or appoint-
ed official who has a
conflict of interest on a
matter shall refrain
from voting on or other-
wise participating in
any actions or deci-
sions regarding such
matter. In such cases,
a public disclosure
shall be made as fol-
lows: (a) in the case of
the Mayor or any
Councilor, the interest-
ed official shall advise
the City Council of the
nature of the official’s
conflict of interest prior
to City Council con-
sideration of the matter
giving rise to the con-
flict, and a notation re-
garding such conflict of
interest shall be en-
tered in the City Coun-
cil minutes which relate
to such matter; (b) in
the case of a member
of a commission or
board of the City, the
interested member
shall advise the other
members of such com-
mission or board of the
nature of the member’s
conflict of interest prior
to consideration of the
matter giving rise to
the conflict, and a nota-
tion regarding such
conflict of interest shall
be entered in the
minutes of such com-
mission or board relat-
ing to such matter.
In the case of a sale,
lease or contract in
which an elected or ap-
pointed official with au-
thority to take part in
any manner in the
making of the transac-
tion has a personal
financial interest, nei-
ther the City Council
nor any commission or
board of the City shall
approve such transac-
tion except as allowed
by law.

Preparation of Annual
Budget, is hereby
amended as follows

Budget – Preparation of
Annual Budget. On or
before the first last reg-
ular meeting in Sep-
tember of each year,
the City Manager shall
prepare a proposed
budget of the revenue
and expenditures of
the City for the next fis-
cal year, which shall
contain a detailed esti-
mate of the revenues
and requirements of
each fund for such
year, and a comparis-
on of budgeted
categories with the
corresponding items
for the current fiscal
year and the preceding
two or more fiscal
years. The proposed
budget shall be accom-
panied by the recom-
mendation of the City
Manager as to the
amount to be appropri-
ated for each fund, with
reasons therefor, in
such detail as the City
Council may direct.
The City Manager may
submit with the pro-
posed budget such ex-
planatory statement or
statements as neces-
sary. The proposed
budget shall be in print-
ed or electronic form. A
copy thereof shall be
furnished to the Mayor,
City Manager, Finance
Director, and each
member of the City
Council. A printed copy
of the proposed budget
shall be available for
inspection or examina-
tion by any person dur-
ing regular business
hours at the office of
the Finance Director,
and the proposed
budget shall also be
available to the public
by means of electronic
posting and/or com-
munication.
SECTION 2. That the
City Charter for the
City of New Ulm, Sec-
tion 115, Passage of
the Budget, is hereby
amended as follows

Section 115. Passage
of the Budget. The
budget shall be con-
sidered at the first last
regular monthly meet-
ing of the Council in
September, and the
Council shall hold ad-
journed meetings from
time to time until all the
estimates have been
considered. The meet-
ings shall be so con-
ducted as to give in-
terested citizens rea-
sonable time in which
to be heard, and an op-
portunity to make such
inquiries as may seem
pertinent to them. The
City Manager shall ex-
plain the various items
thereof as fully as may
be deemed necessary
by the Council. The an-
nual budget as finally
agreed upon shall be
adopted by resolution
setting forth the budget
in detail, and a sum-
mary thereof shall be
recorded in the
minutes of the Council
proceedings. The
Council shall adopt a
budget resolution not
later than the second
regular monthly meet-
ing in December.
SECTION 3. Pursuant
to Minn. Stat. Å’ 410.12,
subd. 7, this ordinance
shall be effective 90
days after its adoption
and second publica-
tion.

City Charter for the
City of New Ulm, Sec-
tion 214A, is hereby re-
pealed and replaced in
its entirety as follows:
Section 214A. Lien and
Certification for Unpaid
Utility Services. Utility
charges and services
provided for in this sec-
tion shall be the pri-
mary responsibility of
the owner of the prem-
ises served and all
such charges and pay-
ments shall be a lien
upon the property re-
ceiving the utility ser-
vices. The Finance
Director shall have the
authority to collect del-
inquent charges by any
lawful means available
including, but not by
way of limitation
through collection
agencies, Certification
for payment in the
same manner as the
property taxes, and the
Minnesota Revenue
Recapture Act.
SECTION 2. Pur-
suant to Minn. Stat. Å’
410.12, subd. 7, this
ordinance shall be ef-
