GULATION OF THE
NEW ULM CITY
CODE

SECTION 1. That
Chapter 5: Liquor
Licensing and Regula-
tion Section 5.25, In-
toxicating liquor license
required, of the City
Code of the City of
New Ulm is hereby
amended as follows
Section 5.25. Intoxicat-
ing liquor license re-
quired.
Except as otherwise
provided in this
chapter, it is unlawful
to sell, keep, or offer
for sale, any intoxicat-
ing malt liquor, wine, or
intoxicating liquor
without an annual
license therefor from
the City. This section
shall not apply (1) to
possession or handling
for sale or otherwise of
sacramental wine by
any representative of
any religious order or
for use in connection
with a legitimate reli-
gious ceremony, (2) to
such potable medica-
tions containing alcohol
as are prescribed by
licensed physicians
and dentists for thera-
peutic purposes, (3) to
industrial alcohol and
its compounds not
prepared or used for
beverage purposes, (4)
to wine in the posses-
sion of the holder of an
on-sale wine license is-
sued by the City, (5) to
wine furnished by facil-
ities which are author-
ized by Minnesota Sta-
tutes to furnish wine
without a license, or (6)
to sales by manufactur-
ers to wholesalers duly
licensed as such by the
State of Minnesota and
to sales by wholesalers
to holders of on-sale or
off-sale licenses from
the City. An applicant
who meets the require-
ments for licensing pro-
vided in Minnesota
Statutes, Chapter
340A, as may be
amended from time to
time, may be issued an
on-sale intoxicating
liquor license, an
off-sale intoxicating
liquor license, or both.
The holder of an
on-sale intoxicating
liquor license may sell
food for consumption
on the premises, sub-
ject to all licensing re-
quirements for food
and beverage estab-
lishments.
SECTION 2. That
Chapter 5: Liquor
Licensing and Regula-
tion Section 5.34,
Microdistilleries, of the
City Code of the City of
New Ulm is hereby
amended as follows
Section 5.34. Microdis-
tilleries.
for the purposes of
summer collegiate
league baseball
games, town ball
games, and any other
events at the ballpark
or stadium shall be eli-
gible for an on-sale
wine and on-sale malt
liquor license.
SECTION 4. That
Chapter 5: Liquor
Licensing and Regula-
tion, Section 5.42,
Temporary on- sale in-
toxicating liquor
license, of the City
Code of the City of
New Ulm is hereby
amended as follows
Subdivision 3. An
off-sale distilled spirits
licenses may be grant-
ed to
microdistilleries, sub-
ject to the limitations of
this chapter and the
additional limitations as
follows:
A. The microdistillery
may sell up to a total of
750 milliliters per cus-
tomer per day of pro-
duct manufactured
on-site;
B. Off-sale hours of
sale shall conform to
hours of sale for retail
off-sale licensees;
C. No brand may be
sold at the microdistil-
lery unless it is also
available for distribu-
tion by wholesalers.
SECTION 3. That
Chapter 5: Liquor
Licensing and Regula-
tion of the City Code of
the City of New Ulm is
hereby amended to
add a new section 5.36
as follows:
Section 5.36. Baseball
on-sale wine and malt
liquor license.
A person who is the
owner of a summer
collegiate league base-
ball team or baseball
team competing in a
league established by
the Minnesota Base-
ball Association, or a
person holding a con-
cessions or manage-
ment contract with the
owner for beverage
sales at a ballpark or
stadium located within
the city
Section. 5.42. Tem-
porary on-sale intoxi-
cating liquor license.
Subd. 3. Temporary
on-sale liquor license
exception for county
fair. A temporary
on-sale license may be
issued once per year to
a county agricultural
society established
under Minnesota Sta-
tutes Å’ 38.01, for al-
coholic beverage sales
at a county fair for up
to seven (7) consecu-
tive days.
SECTION 5. That
Chapter 5: Liquor
Licensing and Regula-
tion of the City Code of
the City of
New Ulm is hereby
amended to add a new
section 5.46 as follows:
Sec. 5.46. Extended
hours for on-sale dur-
ing World Cup.
Subdivision 1. Notwith-
standing the restric-
tions on the days and
hours for on- sale of in-
toxicating liquor or 3.2
percent malt liquor in
this section, during a
FIFA Women’s World
Cup competition or
FIFA World Cup com-
petition, a special per-
mit may be issued for
service of alcohol
through extended
hours. The permit only
authorizes the sale of
alcoholic beverages 30
minutes before, during,
and 30 minutes after a
scheduled broadcast of
a live World Cup
match. The sales au-
thorized under this
subdivision are not al-
lowed during broad-
casts of previously
played matches. Only
holders of an existing
on-sale intoxicating
liquor license or a 3.2
percent malt liquor
license are eligible for
the extended hours.
Subd. 2. This section
expires September 1,
2023.
SECTION 6. This Ordi-
nance shall take effect
and shall be in force
thirty (30) days from
and after its adoption,
approval, and publica-
tion.
