NOTICE OF INTENT TO OPERATE AERATION SYSTEM

Notice is hereby given that Brown County in conjunction with the Minnesota Department of Natural Resources plan to operate a helixor aeration system near the east shoreline of Lake Hanska below Fort Hill in Lake Hanska County Park in Section 33-T108N-R31W in Lake Hanska Township of Brown County.

Operation of the system will begin between January 20, 2022 and February 28th, 2022 as the lake conditions warrant. Weather conditions may cause the areas of thin ice and open water to fluctuate greatly. STAY CLEAR OF THE MARKED AREAS! The marked area is restricted by Brown County Ordinance 1993-04. Please call 507-233-6640 with questions about the aeration system.

Brown County Resolution

The following Resolution was offered by Commissioner Borchert and moved for adoption at a Regular Meeting held on January 18, 2022 at the Brown County Court House, New Ulm, MN:

WHEREAS, pursuant to MS. 373.01, Brown County has previously approved the Countyowned land sale of parcel number R001.001.052.04.040, described as follows: Lot 4, Block 52, North of Center, City of New Ulm, Brown County, Minnesota, and located at 1315 German Street N., New Ulm, MN 56073

WHEREAS, the minimum sale price has been set at $106,380.00;

WHEREAS, the terms of the sale will be cash only, including applicable fees;

WHEREAS, all minerals and mineral rights will be reserved by Brown County;

NOW, THEREFORE BE IT RESOLVED, that the Brown County Board of Commissioners authorizes the land sale to take place on February 28, 2022 at 3:00 PM in Room #204 of the Brown County Courthouse located in New Ulm, Minnesota 56073;

BE IT FURTHER RESOLVED, that the Brown County is authorized to issue a deed for the property to the highest bidder.

BE IT FURTHER RESOLVED, that a Public Notice for bids for the Brown County Direct County Land Sale shall be published according to Statute (Exhibit 1 attached).

Seconded by Commissioner Windschitl and the same being put to a vote was duly carried. This Resolution shall become effective immediately and without publication.

Adopted by the following vote: Ayes 5 Nayes 0.

NOTICE OF BROWN COUNTY DIRECT COUNTY LAND SALE

DATE: February 28, 2022m at 3:00 p.m.

LOCATION: Brown County Courthouse, Commissioner Room #204, 14 S State Street, New Ulm, MN

NOTICE IS HEREBY GIVEN, for sale to the highest bidder at the COMMISSIONER’S ROOM #204 in the BROWN COUNTY COURTHOUSE, CITY OF NEW ULM, COUNTY OF BROWN, MINNESOTA, the following described parcel of land: Lot 4, Block 52, North of Center, City of New Ulm, Brown County, Minnesota, and located at 1315 German Street N., New Ulm, MN.

Said sale will be governed as to terms by resolution of the County Board authorizing the same and shall commence at 3:00 P.M. on February 28, 2022.

TERMS OF SALE: The Property shall be sold on the following terms, to wit: the parcel will be sold to the highest bidder at not less than $106,380.00. Bidding shall be by submitting sealed bids that have been mailed to Brown County Administrator PO Box 248, New Ulm, MN or dropped off at the County Administrator’s Office, Brown County Courthouse, Room #211, 14 S. State Street, New Ulm, MN. Bids shall include the name, address, phone number, and proposed purchase price. Sealed bids shall be opened on the date of the sale. All submitted bids shall be made on a dollar basis for the total value of the tract, and in no case will less than $100.00 bid raises be considered. Fifteen percent (15%) of the final purchase price must be paid on the day of the land sale. Any remaining balance must be paid within 30 days.

The following personal property is included in the sale: stove with cook top, dishwasher, basement refrigerator, water softener, water heater, furnace, wood burning stove, couch, recliner, 2 single beds.

The land and improvements are being sold AS IS and the County makes no warranties as to the condition of any buildings, wells, septic systems, if any, soiled, roads, or any other condition of the property.

The tract is being sold with the understanding that the buyer and seller agree to waive disclosures required under Minnesota Statutes Chapters 513.52 to 513.60, and any associated liabilities. No representation is made as to the condition of the structures, their fixtures or contents, or their suitability for any particular use.

Purchasers of direct county land will receive a Quit Claim Deed from Brown County. Pursuant to the terms of Minn. Stat. 373.01, all mineral rights shall be reserved on direct county lands, together with the right to explore for, mine, and remove minerals thereon.

ALL SALES ARE FINAL. IN CASES OF PAYMENT DEFAULT, BROWN COUNTY WILL RETAIN THE DOWN PAYMENT (15% OF PURCHASE PRICE) AS PENALTY AND DAMAGES, AND WILL, AT ITS SOLE DISCRETION, DECIDE WHETHER THE PROPERTY WILL BE RE-OFFERED TO THE NEXT HIGHEST BIDDER.
