NOTICE AND ORDER OF HEARING ON PETITION FOR PROBATE OF WILL AND APPOINTMENT OF PERSONAL REPRESENTATIVE AND NOTICE TO CREDITORS

It is Ordered and Notice is given that on April 26, 2021 at 2:00 p.m., a hearing will be held in this Court at 14 South State Street, New Ulm, Minnesota, for the formal probate of an instrument purporting to be the Will of the Decedent dated, December 15, 2010, (“Will”), and for the appointment of Radburn Royer, whose address is 23565 Buttercup Lane, Aitkin MN 56431 as Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.

Notice is also given that (subject to Minnesota Statutes section 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

NOTICE OF AND ORDER FOR ADMINISTRATIVE HEARING ON PETITION FOR DETERMINATION OF DESCENT AND APPOINTMENT OF SPECIAL ADMINISTRATOR

Due to Supreme Court Order ADM20-8001, it is Ordered and Notice is given that on April 26th, 2021 at 2:00 o’clock p.m., the above matter will come before this Court located at 14 South State Street, New Ulm, Minnesota, for administrative review, on a Petition for Determination of Descent and Appointment of Special Administrator dated January 7, 2021 and for the appointment of Kevin E. Passe, whose address is PO Box 127, Redwood Falls, MN 56283, as special administrator of the Decedent’s estate.

The petition represents that the decedent died more than three years ago, leaving property in Minnesota and requests the Court determine the descent of such property and assign the property to the persons entitled.

Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the petition will be granted and the special administrator will be appointed with the full power to administer the Decedent’s estate, including the power to collect all assets; to pay all legal debts, claims, taxes, and expenses; to sell real and personal property; and to do all necessary acts for the Decedent’s estate.

Notice shall be given by publishing this Notice and Order as provided by law and by mailing a copy of this Notice and Order to each interested person by United States mail at least 14 days before the time set for the hearing.
