NOTICE OF PUBLIC HEARING

In the Matter of the Redetermination of Benefits of

Judicial County Ditch Systems 36 Blue Earth & Brown

Whereas, The Joint Drainage Authority of Blue Earth and Brown Counties, has appointed viewers to redetermine the benefits and damages for Judicial County Ditch Systems 36 Blue Earth & Brown, and whereas, the Viewer’s report for the Redetermination of Benefits has been filed with the appropriate authorities in the respective counties.

NOW, THEREFORE, Notice is hereby given that the Drainage Authority will hear public comment on the acceptance of the redetermination of benefits on this ditch systems beginning at 1:30 p.m. at the Blue Earth County Historic Courthouse, 2nd Floor Commissioners Room, Mankato, Minnesota on January 21, 2020. All persons interested in the redetermination of benefits and wanting to be heard should appear at this time. If accepted, the redetermined benefits will replace those now being used and all future maintenance expenses will be assessed based upon the redetermined benefits.

ORDINANCE NO. 19- 035, FIFTH SERIES CITY OF NEW ULM, BROWN COUNTY, MINNESOTA

AN ORDINANCE AMENDING CHAPTER 9 OF THE CITY CODE OF THE CITY OF

NEW ULM RELATIVE TO USES BY CONDITIONAL USE PERMIT

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM:

SECTION I. That Chapter 9 of the City Code of the City of New Ulm is hereby amended to add the following:

Section 9. 10. B- 2 Service Business District

Subd. 3 Uses by conditional use permit. Within a B- 2 Service Business District, a building or land may be used for one or more of the following uses only by conditional use permit.

C. Apartment dwellings, town houses, row houses, and individual apartments in an existing structure, but applicable only to real property legally described as:

Lots 8- 10, Block 69 North;

Lots 1- 7, Block 102 North;

Lots 1- 7, Block 103 North;

Lots 1- 7, Block 104 North;

Lots 8- 14, Block 67 South;

Lots 8- 13, Block 183 South.

1. A condition of any conditional use permit allowing such use shall require the

provision of 1. 5 off-street parking stalls per dwelling unit.

a. Parking stalls shall be provided on- site, or the owner of the property on which there is a dwelling unit must provide to the City proof, in the form of a contract or lease, that they have obtained the right to use the necessary amount of parking

stalls off site at the time of the issuance of the conditional use permit and annually by January 1st of each year hereafter.

b. Joint business/ dwelling unit parking facilities are permitted provided that the total

number of spaces shall equal the total number of parking spaces required for each use.

2. Dwelling units proposed for the main floor or 1st floor of a building are subject to the following requirements:

a. The minimum floor area for a business shall be no less than 60% of the total main floor area and shall be no less than 850 square feet in size.

b. The minimum dwelling unit size shall be no less than 400 square feet for an efficiency apartment and no less than 520 square feet for a one bedroom apartment.

c. The residential component of the structure may not be facing the front of the building, which shall be identified in the permits.

SECTION II. That this ordinance shall take effect and shall be in force 30 days from and

after its adoption, approval, and publication.

NOTICE OF AND ORDER FOR HEARING ON PETITION FOR FORMAL PROBATE OF WILL AND APPOINTMENT OF PERSONAL REPRESENTATIVE AND NOTICE TO CREDITORS

It is Ordered and Notice is given that on February 3, 2020 at 9:00 AM a.m./p.m., a hearing will be held in this Court at the Brown County Courthouse, 14 South State Street, New Ulm, Minnesota 56073-0248, for the formal probate of an instrument purporting to be the decedent’s Will dated December 17, 2008, and for the appointment of David R. Dalueg, whose address is 21455 3rd St., New Ulm, Minnesota 56073, as personal representative of the estate of the decedent in an unsupervised administration.

Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the personal representative will be appointed with the full power to administer the estate, including the power to collect all assets; pay all legal debts, claims, taxes, and expenses; sell real and personal property; and do all necessary acts for the estate.

Notice is also given that, subject to Minn. Stat. 524.3-801, all creditors having claims against the decedent’s estate are required to present the claims to the personal representative or to the Court within four (4) months after the date of this notice or the claims will be barred.
