It is with deep regret that the attorneys of this judicial district received the announcement of Judge A. B. Gislason’s intention to resign from the bench. The first intimation of such contemplated action was rumored about ten days ago when the Judge informed some of his close friends that he would leave the bench and again engage in the practice of law in the city of Marshall. For the purpose of considering the pending resignation and making recommendations for a possible successor, members of the bar from the district met at the commercial club rooms in this city Friday afternoon.

Hauser Presides

Every county was represented and Albert Hauser, the newly elected president of the bar association, presided and Linus Glotzbach of New Ulm acted as secretary. This meeting was not considered as a meeting of the Association, because no official notice had been sent out for this purpose. It was an informal gathering of attorneys to discuss a situation which presented itself thru the proposed resignation of Judge Gislason.

Judge To Resume Law Practice

Friends of the Judge from Lyon County stated that for personal reasons and on account of the opportunities offered to engage in the practice of law in Marshall owing to the death of Attorney Rollin Mathews, the Judge felt that he owed it to himself to resign from the bench. His resignation at this time means the appointment of a Judge by Governor Christiansen who will hold office only until January 1, 1927.

This means that whoever is appointed will have to make a campaign this fall. Judge Olsen’s term also expires this fall and thus instead of one, two Judges would have to be elected in this year’s general election and that both of them would come up for re-election six years hence, unless in the meantime there would be created a vacancy either by death or resignation.

This is not desirable and the question was asked whether or not Judge Gislason could be prevailed upon to hold his resignation in abeyance until after the election in November. His friends from the west end said that possibly a unanimous request from the members of the bar might have the desired effect, but that the attorneys hardly had a right to ask the Judge to forego a business opportunity which might not present itself again.

It was generally conceded by all attorneys present that the west end of the district was entitled to the Judge. In speaking for Lyon County Attorney Jas. A. Hall state that Lyon County had no candidate and all that they asked for was that whoever was appointed should move to Marshall for the convenience of the attorneys of the west end.

Endorses Enersen

Redwood County reported that the only attorney from their county who was in a receptive mood was Attorney Albert Enersen from Lamberton. L.P. Johnson of Lincoln County stated that Attorney Schulz from Ivanhoe had told him before he came to the meeting that he would not be averse to accepting the appointment if it were offered him. None of the other counties had any candidates to propose. Upon an informal vote Attorney Enersen received 16 votes, Attorney Schulz 2 votes and Attorney Hauser one vote. The formal ballot showed the same result and upon motion the chair was directed to appoint a committee of five, one from each County to wait upon the Governor and appraise him of the result of their deliberations. For Nicollet County George T. Olsen was appointed; Brown County, Albert Hauser, by request of the members of the bar of the county; Redwood County will be represented either by A. R. Dolliff or George Barnes of Redwood Falls; Lyon County by A. R. English of Tracy and L. P. Johnson consented to send in the name of the attorney to be selected by the bar of Lincoln County.

Attorneys Present

The following attorneys were present at the meeting: L. P. Johnson, Ivanhoe; Jas. A. Hall, Marshall; A. R. English, Tracy; A. R. Dolliff, George Barnes, A. R. A. Lauden, and N. R. Ryerson of Redwood Falls, Henry N. Benson, M. E. Stone and George T. Olsen of St. Peter and Henry N. Somsen, W. H. Dempsey, W. T. Eckstein, Albert Steinhauser, Albert D. Flor, Alfred W. Mueller, George D. Erickson and Linus Glotzbach. Judge I.M. Olsen was also present at the meeting and took part in the discussion but did not take part in the vote.

After the enactment of the law making provision for two Judges in this district in 1923, Governor Preus appointed Mr. Gislason Judge upon the unanimous endorsement of the members of the bar of the district. Mr. Gislason was elected to a full term of six years in the general election held in November 1924. Since his appointment Judge Gislason has divided the work of this district with Judge Olsen. It is generally conceded that he performed his duties faithfully and impartially, hence the universal regret that he should resign, at this time. It, is rumored that he will be associated with Attorney Jas. A. Hall as soon as his resignation has been accepted and his successor has been elected and has qualified.
