JULIUS RETURNS WITH PRISONER FROM UTAH
Howard Healy Again
Lands In Jail And Must
Stand Court Trial.
——–
W. J. Julius, sheriff of Brown County, and Herman Polchow, chairman of the county board returned Tuesday morning from Ogden, Utah, where they went to bring back Howard Healy, who is wanted by the local court for jumping his bond and for failure to stand trial on the charge of pickpocketing. The officers left a week ago Wednesday for the Utah city to get their man.
Sheriff Julius reports that in order to get Healy out of the state it was necessary for him to make a fast drive to get across the border of Utah in order to prevent the serving of restraining papers on him by attorneys for Healey. He had intended to leave Monday morning with his prisoner but heard on Sunday that some attorneys were trying to serve papers in order to demand a hearing for Healy. He immedaitely got into touch with the police of that city and took his prisoner into a big car and rushed across the border, a distance of 96 miles, over rugged plains, and steep mountains, making the trip in two and one-half hours. Just before they reached the state line they were stopped by federal officers and thought they would have to return, but found that they were only required to sign a paper showing that the prisoner had been delivered to the local sheriff.Healy is now in the county jail awaiting tríal. The charge against him is one of pickpocketing, the act having taken place during the Brown County Fair last year. Healy has quite a record behind him and no doubt will be given a stiff sentence if convicted.

At a conference of Judge A. B. Gislason and attorneys for the state and defense, at St. Peter, Tuesday afternoon, it was agreed that the second trial of Julius Hopp, charged with the murder of Louis Wills, Jr., on April 24, in Granby township, Nicollet county, would be called on September 14. It was also agreed that the place of trial would be at Redwood Falls, St. James or Glencoe. This will be decided later. Judge Gislason will pre-side during the second trial.
The first trial, held in St. Peter, closed Tuesday of last week with a disagreement of the jury, after being out 22 hours. The jury stood eight for conviction and four for acquittal, it is said. It is further stated that the four women on the jury were for ac-quittal. The following day the defendant was admitted to bail, in the sum of $10,000, as was stated in the Jour-nal last week.
Settlement Made
A settlement was made in the case of State of Minnesota vs. Florian Walser, which was on the calendar for trial at the last term of court. Judge Gislason entered an order directing the defendant to pay the sum of $1,500.
Juror Excused
Floyd Cole was excused from jury duty Tuesday afternoon, by reason of his brother, Archie Cole, being injured by a gunshot wound in Belgrade township about noon that day. He was taken to Immanuel hospital at Mankato. The shot took effect in the young man’s side. Floyd Cole was a juror, sitting in a case, which was being tried, but was excused by Judge Gislason, the attorneys proceeding with eleven jurors.
