NOTICE IS HEREBY

given that the City

Council will hold a pub-

lic hearing on Tues-

day, October1, 2013 at

5:00 p.m. at the Coun-

cil Chambers in City

Hall, 100 North Broad-

way in the City of New

Ulm, Minnesota, and

consider adoption of

the final special as-

sessment prepared by

the City Manager to

defray the cost of the

following improve-

ments:

UTILITY, STREET

AND ALLEY IM-

PROVEMENT

GROUP I

The improvements

constructed on this

project that are being

specially assessed at

this time are as fol-

lows:

1. Minnesota Street

from 7th South Street

to 13th South Street

Reconstruction of the

existing water main,

sanitary sewer main,

sewer and water end

services, and recon-

struction of the exist-

ing roadway section in-

cluding excavation and

replacement of

subgrade, storm sewer

modifications, aggre-

gate base, bituminous

paving, concrete curb

and gutter, concrete

driveway pavement,

pedestrian sidewalk

ramps, street lighting

and selective replace-

ment of concrete side-

walk.

2. Summit Avenue

from Center Street to

10th South Street

Reconstruction of the

existing water main,

sanitary sewer main,

sewer and water end

services, storm sewer

extension and outfall

restoration, and recon-

struction of the exist-

ing roadway section in-

cluding excavation and

replacement of

subgrade, pavement

edge drains, aggregate

base, bituminous pav-

ing, concrete curb and

gutter, concrete drive-

way pavement, pedes-

trian sidewalk ramps,

street lighting and

selective replacement

of concrete sidewalk.

3. Sanitary Sewer

Easement from

Second South Street

to Summit Avenue

Reconstruction of the

existing sanitary sewer

main and hillside res-

toration.

4. North/South Leg of

the T-Alley in Witt's

Addition Grading, ag-

gregate base, storm

sewer, bituminous sur-

facing, seven inch (7")

concrete alley ap-

proach pavement, mis-

cellaneous removals

and restoration neces-

sary to construct a

residential alley pave-

ment section (im-

provement petitioned).

5. Alley Block 128

South of Center Street

Grading, aggregate

base, bituminous sur-

facing, seven inch (7")

concrete alley ap-

proach pavement, mis-

6. Sidewalk Improve-

tions will be con-

sidered at the public

hearing. No appeal

may be taken as to

the amount of an as-

sessment unless a

signed, written objec-

tion is filed with the Fi-

nance Director prior to

the hearing or present-

ed to the presiding off-

icer at the hearing.

After the public hearing

the City Council may

adopt the proposed

special assessment

roll. You will have 30

days from the adoption

date to pay the entire

final special assess-

ment amount without

interest to the Brown

County Auditor-

Treasurer's Office.

After such time, you

may pay to the County

Auditor the entire

amount of the as-

sessment remaining

unpaid, plus the in-

terest accrued to De-

cember 31st of the

year in which such

payment is made.

Such payment to the

County must be made

before November 15th

or interest will be

charged through De-

cember 31st of the

succeeding year. The

unpaid balance of any

assessment will be

levied by Brown Coun-

ty and will be collected

as an assessment on

your property tax

statement over a ten

(10) year period along

with a 3.25% percent

simple interest charge

on the unpaid balance.

An owner may appeal

an assessment to dis-

trict court pursuant to

Minnesota Statutes

Section 429.081 by

serving notice of the

appeal upon the Mayor

or Finance Director of

the of the City within

30 days after the

adoption of the as-

sessment and filing

such notice with the

district court within ten

days after service

upon the Mayor or Fi-

nance Director.

Under Minnesota Sta-

tutes 435.193 to

435.195 the Council

may, in its discretion,

defer the payment of

this special assess-

ment for any home-

stead property owned

by a person 65 years

of age or older for

whom it would be a

hardship to make

these payments.

When deferment of the

special assessment

has been granted and

is terminated for any

reason provided by

law, all amounts accu-

mulated plus applica-

ble interest become

due. Any assessed

property owner meet-

ing the requirements of

this law and City Code

Section 2.80 adopted

under it may, within 30

days of the confirma-

tion of the assessment

apply to the Finance

Director on such forms

as are prescribed by

the County Auditor for

such deferral of pay-

ment of this special

assessment on his

property.

The improvements

1. Flood Hazard Miti-

gation Project Con-

struction of a per-

manent flood control

levee adjacent to the

Minnesota River ap-

proximately 5,000 feet

in length, including the

acquisition of real

estate and internal

drainage components

necessary to complete

the project. The levee

shall be constructed to

an elevation two feet

(2') above the base

flood (1% chance)

elevation, and a have

a top width of 12 feet,

4:1 (h:v) side slopes.
