Members present: Seeboth, Berg, Dove, Lochner, and Potter along with Administrator Enter and County Attorney Hinnenthal.

M/Dove, S/Potter, to accept the Minutes of 8-3-10 and authorize publication of the Synopsis of same, carried.

M/Potter, S/Dove, to authorize the payment of General Government claims in the amount of $117,688.00, carried.

M/Berg, S/Lochner, to approve two (2) Drainage Ditch Repair requests, carried.

Chairman Seeboth appointed Commissioners Berg and Potter to an ad hoc committee to meet with A/T Helget, Ditch Inspector Holtz, and Personnel Director Crabtree to review county ditch administrative processes.

A/T Helget reported on the 8:45 AM teleconference held this date in the Brown County Courthouse Room 204 which included JD#10 B&BE Commissioners Seeboth, Berg, and Dove, and Commissioners Purvis and Bruender of Blue Earth County, whereby the JD#10 B&BE Ditch Authority on a motion by Seeboth, seconded by Dove, approved unanimously the request of landowners Doug Koehler and Jason Peterson to remove Bridge #28, JD#10 B&BE, located in Section 2 of Linden Township in Brown County, contingent on documentation approved by the county attorney. M/Berg, S/Dove, to accept and file the report on the action of the JD#10 B&BE Authority this date 8-17-10, carried.

M/Potter, S/Dove, to accept and file the Cash Management/Investment Report for the month of July which reflects a portfolio balance of $18,191,889.87 with an Investment Portfolio Weighted Average Yield of 0.93% which includes an average rate of 1.48% on $9,975,000.00 of CD's currently invested, carried.

M/Potter, S/Dove, to table consideration of final payment to B & H Petroleum in the amount of $2,622.58 for the replacement of the fuel dispensing system at the Highway Dept. until the 8-24-10 County Board meeting, carried.

M/Lochner, S/Berg, to approve final payment to Veenstra & Son LLC in the amount of $1,942.50 for aggregate crushing for maintenance gravel, carried.

M/Lochner, S/Seeboth, to accept and order filed the July 2010 Monthly Reports of Activity for the Brown County Sheriff's Dept., carried.

M/Berg, S/Dove, to accept and file the following Public Health Update: The Public Health Standards; Tobacco Modernization Act; Childhood Lead Poisoning Prevention Month; School Based Influenza Vaccine Clinic Update; Seasonal Influenza Vaccine Campaign; Adult and Adolescent Immunization Campaign; Availability of Occupational Therapy/Physical Therapy Contract; Women, Infant, Children (WIC) Nutrition Program Area; Southern MN Initiative Foundation (SMIF) Grant; Advisory Committee Meeting Minutes of 6-2-10, carried.

M/Lochner, S/Potter, to accept the resignation of Mary Krebs, FT Public Health Nurse/Disease Prevention & Control/Emergency Preparedness effective 9-23-10 and authorize filling the position by posting internal/external simultaneously, and approve retaining Mary Krebs in an Intermittent Part Time status for a period of up to four months, carried.

M/Berg, S/Dove, to approve the appointment of Lynn Hage as FT Resident Park Caretaker, contingent on the passage of a pre-placement physical, at the annual salary of $31,325.00 (Grade IX, Step 2) and with a projected start date of 8-27-10, carried.

M/Lochner, S/Potter, to approve the Conditional Use Permit (CUP) App. #C-00258 by H & D Underground on property described as part of the SW4 of SE4, Sec. 22T110NR32W, Home Township for the purpose of renewing CUP #C-00093 to continue to allow operation of utility construction company (contractors yard) & storage of related equipment, maintenance shop & office, with four (4) conditions listed, carried.

M/Berg, S/Lochner, to approve the CUP App. #C-00257 by Loren Hoffman for JMLP Inc. on property described as part of the SE4, Sec. 34T110NR32W, Home Township, for the purpose of renewing CUP #C-00065 to continue to allow use of property as a demolition landfill site compliant with MPCA rules for disposal of demolition & earthen material, with four (4) conditions listed, carried.

M/Lochner, S/Dove, to approve the CUP App. #C-00256 by John & Lorraine Hillesheim on property described as part of the SW4 of NW4, Sec. 22T110NR32W, Home Township for the purpose of renewing CUP #8014 for continued use of existing feedlot with up to 936 AU (3120 head) in a hog wean to finish operation, with seven (7) conditions listed, carried.

M/Berg, S/Potter, to approve the CUP App. #C-00260 by Tim Miller for T & J Turkey's on property described as part of the SE4, Sec. 11T108NR31W, Lake Hanska Township for the purpose of renewing & amending existing CUP #C-00126 to expand to up to 77,000 turkeys (1022 AU) in a brooder and finishing operation (includes both Toms and Hens). This is for an expansion of the flock, using (1) 64' X 288' and (3) 76' X 544' existing barns with no new construction onsite, with five (5) conditions listed, carried.

M/Potter, S/Berg, to approve the Preliminary Plat #P-00120 a single lot split by Tim Stadick known as Stadick Subdivision, on property described as part of the NW4 & part of the SW4 Sec. 03 & 04T109NR30W, Cottonwood Township. Property being platted is an existing home site being combined with surrounding land to create one lot of approx 4.16 acres in the A-1 Agricultural Zoning District, with one (1) condition listed, carried.

M/Lochner, S/Dove, to approve the Final Plat #P-00119 a single lot split by Kenneth Hauser Etal Charles Tews for Tews Farms Inc. known as Hauser First Subdivision, on property described as part of SE4 Sec. 36T110NR32W, Home Township & as part of NE4 Sec. 1T109NR32W, Stark Township, carried.

M/Lochner, S/Dove, to approve submission of a Three Rivers RC&D Grant for the cleanout of the Mound Creek Sedimentation Pond, carried.

M/Lochner, S/Dove, to accept and file the Brown County Sanitary Landfill Tier II Landfill Gas Emissions Report from testing conducted by AECOM on May 26 and 27, 2010, carried. It was noted the LandGEM results indicate that the NMOC emission rate is below the federal threshold rate, therefore the Brown County Landfill is not required to install a landfill gas collection and control system.

M/Lochner, S/Potter, to authorize the payment of Family Services Administrative claims in the amount of $95,800.57, carried.

At 10:27 AM, Chairman Seeboth convened a Closed Session to consider Social Services Payments, whereupon M/Potter, S/Berg, to authorize the payment of Social Services payments in the amount of $222,708.45, carried. The Closed Session ended at 10:30 AM.

Correspondence C-1 thru C-9 were accepted and filed.

Berg reported on the Veterans Memorial Purple Heart dedication on 8-7-10; and Lochner reported on AREA II, Detox, and SCHA matters.

M/Potter, S/Berg, to authorize receipting the MCIT 2010 dividend to be received for Brown County as follows: $204,124.37 into the Revenue Fund (01-149.5845) and $846.63 credited to the City of New Ulm as a proportionate dividend share related to the Law Enforcement Center property/casualty insurance premium share paid by the City of New Ulm, carried.

M/Lochner, S/Berg, to accept and file the July 2010 Budget Report (Cash Basis and Unaudited) which reflects activity at 58.3% of the budget year as follows: expenditures of $13,547,372.04 or 47.7%, and revenues of $16,966,697.29 or 60.8%; and the July 2010 Supplemental Budgets Report noting expenditures of $739,783.62 or 39.9%, and revenues of $799,817.07 or 42.8% of annual budgeted activity, carried.

At 10:45 AM, Eden Township landowner Randy Schroeder and fourteen (14) citizens including Representative Paul Torkelson met with the County Board regarding the proposed route of the CapX2020 transmission line through Eden Township, noting that a Route Permit was recently approved by the Minnesota Public Utilities Commission (MN PUC). Many issues were raised regarding the proposed route including: 1) a children's day care facility within a quarter mile; 2) an adjacent county drainage ditch; 3) proximity to residences; 4) bordering two residences on two sides. It was also stated that the proposed route is comparatively harsh on residences than alternative routes that are possible in this area. After lengthy discussion, M/Lochner, S/Berg, to authorize the Board Chair to send a letter to CapX2020 representatives to request a direct meeting with Eden Township residents at this time to address local concerns regarding the proposed CapX2020 transmission line route through Brown County, carriedCalendars were coordinated for the next two week period.

There being no further business, Chairman Seeboth adjourned the Meeting at 11:35 AM.
