K9 narcotic sniff leads to charges

NEW ULM — An exterior narcotic sniff of a vehicle Friday, May 31 lead to felony 5th degree drug possession and drug possession over 1.4 grams of marijuana in a motor vehicle charges for a 41-year-old New Ulm man.

Charges were filed in Brown County District Court Monday against Joshua L. Graves, 101 Minnesota St. N. He was released on his own recognizance early Monday afternoon with conditions including no alcohol or controlled substance use or possession. An omnibus hearing was set for 8:30 a.m., July 2.

According to court documents, New Ulm Police were on patrol near the intersection of Highway 14 and County Road 29 at 7:38 p.m. Friday when they noticed a silver Olds Intrigue whose owner, Dillon Huddleston, has a revoked driver’s license.

Police stopped the vehicle, talked to Huddleston and detected a minor marijuana odor coming from the vehicle. Police asked him about the odor but Huddleston denied having or recently having marijuana in the vehicle.

Police had their K9 partner, Booker, do an exterior narcotic sniff of the vehicle before they had Graves and Huddleston exit the car. The K9 indicated to the narcotic odor on the right front passenger door.

Police searched the car interior and Huddleston and Graves who possessed a bag containing marijuana and a box labeled “DANK VAPES.” Inside the box, police saw a “pen” containing a brown substance, commonly known to be marijuana wax.

Graves was arrested for 5th-degree possession and transported to the Brown County Jail. The green, leafy substance in the bag weighed 5.29 grams and NIK tested positive. The box with the pen read that the substance was 92.52 percent THC and weighed 1.1 grams.
