Lewisville man faces two assault charges in Halloween detox brawl

NEW ULM — A 19-year-old Lewisville man faces two gross misdemeanor 4th-degree assault charges and two misdemeanor 5th-degree assault charges after tussling with law enforcement at the Brown County Evaluation Center on Halloween night.

Charges were filed Thursday in Brown County District Court against Mason L. Maloney, 19, 37700 830th Ave., Lewisville.

According to court documents, New Ulm Police were dispatched to the Brown County Evaluation Center at 10:49 p.m., Oct. 31 to assist with an aggressive man. Police were directed to the kitchen area where Mankato Police Officer Brett Weiss and two detox staff members were trying to restrain a man later identified as Maloney.

Mankato Police officer Weiss said he was dropping off an individual at detox when staff asked him to assist with an aggressive patient. Weiss said he entered the facility and saw Maloney lying on the floor. Weiss said he approached Maloney who hit him with his right fist in the torso.

In addition, Weiss said Maloney then took off all his clothes and went to the sink area and began to douse himself with water. A detox staff member tried to intervene and was kicked.

Weiss said he tried to restrain Maloney and they fell to the floor before several New Ulm Police officers arrived.

Detox staff members told police Maloney voluntarily committed himself to detox after being transported there by a family member. He reportedly used acid before arriving at the facility.

New Ulm Police Sgt. Dean Barstad tried to restrain Maloney so staff members could be removed, but it was difficult due to Maloney being nude, wet and spraying himself with a sink sprayer.

Officers took him to the floor but Maloney continued to yell and struggle. More officers helped handcuff Maloney and carry him to an isolation room. Maloney kicked Barstad in the upper left leg at one point.

Police talked with a detox staff member who said Maloney tried to exit the facility via an emergency exit but was unsuccessful. He then tried to gain access to the office but the staff member would not let him in.

The staff member said Maloney grabbed her wrist and hit her twice. Then a detox patient tried to intervene by grabbing Maloney from behind but Maloney bit him on the left forearm, leaving a very noticeable bite mark. Another detox patient tried to intervene and was placed in a chokehold and punched by Maloney.

Police took photos of the bite mark to the first patient with his department cell phone before the patient was transported to New Ulm Medical Center for injury evaluation.

Maloney was released from the Brown County Jail Thursday on $4,000 unconditional bail. No conditional bail was set, according to court administration.
