AN ORDINANCE

AMENDING

CHAPTER 9 OF THE

CITY CODE OF THE

CITY OF NEW ULM

RELATIVE TO ZERO

LOT LINE STAN-

DARDS

BE IT ORDAINED BY

THE CITY COUNCIL

OF THE CITY OF

NEW ULM:

SECTION I. That

Chapter 9.14 of the

City Code of the City of

New Ulm is hereby

amended to add the

following:

Subdivision 5. Zero

Lot Line Standards

A. Definitions

1. “Dwelling, Single

Family Attached”

means a building con-

taining one dwelling

unit which is attached

to another dwelling or

building on one or

more sides by a com-

mon party wall or

walls, and which is lo-

cated on its own lot.

2. “Lot, Base” means a

contiguous parcel of

land in identical owner-

ship throughout,

bounded by other lot(s)

or street(s), and used

or set aside and avail-

able for use as the site

of one or more build-

ings or definite pur-

pose. References to

“lot” within this Chapter

are synonymous with

“base lot”.

3. “Lot, Unit” means a

specialized lot created

within a base lot simply

for the purpose of de-

fining ownership for

certain multiple family

dwelling types.

4. “Lot Line, Zero Side”

means a condition

where no side yard is

provided between two

(2) or more distinct

dwelling units sharing a

common party wall

(e.g. townhouse, row-

house, twin home, at-

tached residential,

etc.).

5. “Townhouse” means

a group of three (3) or

more single family

residences, contiguous

to each other only by

the sharing of common

party walls, and where

each dwelling unit has

separate and individual

front and rear en-

trances and has open

space on at least two

sides of each unit.

These dwellings may

be one story or two (2)

story buildings but

each unit shall be

designed and con-

structed to house one

single family. Such

structures shall be of

the row or group house

type. No single struc-

ture shall contain more

than eight (8) dwelling

units.

B. Standards. In the

R-2 and R-3 Districts,

the side yard setbacks

for a single family at-

tached dwelling may

be reduced to zero (0)

feet, provided that the

following conditions

are satisfied:

1. Lot Area:

a. The combined area

of the base lot and indi-

vidual unit lots contain

the required amount of

lot area per unit as

prescribed elsewhere

in Chapter 9;

b. All structures shall

comply with the lot

area requirements as

provided in

Chapter 9;

2. Setbacks:

a. Unit lots shall meet

all required setbacks

from the boundaries of

the base lot;

b. Except for setbacks

along the common pro-

perty line, all structures

shall comply with all

other setback require-

ments as provided in

the zoning district regu-

lations:

3. Other:

a. Separate utility ser-

vices shall be furnished

and provided to each

dwelling unit;

b. There shall be a

common party firewall

up to new construction

standards found in the

current Minnesota

State Building Code;

c. The applicant will

record all required

agreements, ease-

ments, and deed

restrictions on all struc-

tures that abut the zero

side lot line;

d. The property and

structures will comply

with all other relevant

zoning district

regulations.

SECTION II. That this

ordinance shall take ef-

fect and shall be in

force 30 days from and

after its adoption, ap-

proval, and publication.
