COTTONWOOD TOWNSHIP
NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE, that on the 12th day of September, 2019, at 7:00 p.m., at the Cottonwood Town Hall, Searles, MN, in Cottonwood Township, Brown County, Minnesota, the Town Board of Supervisors of Cottonwood Town will hold a public hearing regarding assessments for the cost of paving the town roads within the area commonly known as Meadow Creek Drive. The total amount of the proposed assessment for the entire project is $113,500.00. The amount proposed to be assessed per parcel is $7,094.00. The area proposed to be assessed are all properties adjacent to or benefited by the pavement project in Meadow Creek Drive using the unit method of assessment.
At or after the Public Hearing Noticed above, the Cottonwood Town Board may adopt the proposed assessment. You have the right to prepay the entire assessment by making payment to the Cottonwood Town Clerk. Partial prepayment has not been authorized by ordinance. You have until December 31, 2019, to make prepayment without the assessment of interest. Interest will accrue at 5% if the assessment is not prepaid within the required time period.
NO APPEAL MAY BE TAKEN AS TO THE AMOUNT OF ANY ASSESSMENT ADOPTED BY THE TOWN BOARD PURSUANT TO MINN. STAT. Å’ 429.061, SUBDIVISION 2, UNLESS A WRITTEN OBJECTION SIGNED BY THE AFFECTED LANDOWNER IS FILED WITH THE COTTONWOOD TOWN CLERK PRIOR TO THE ASSESSMENT HEARING OR PRESENTED TO THE PRESIDING OFFICER AT THE HEARING.
AN OWNER MAY APPEAL AN ASSESSMENT TO DISTRICT COURT PURSUANT TO MINNESOTA STATUTES SECTION 429.081 BY SERVING NOTICE OF THE APPEAL UPON THE COTTONWOOD TOWN BOARD CHAIR OR CLERK WITHIN 30 DAYS AFTER THE ADOPTION OF THE ASSESSMENT AND FILING SUCH NOTICE WITH THE DISTRICT COURT WITHIN TEN DAYS AFTER SERVICE UPON THE COTTONWOOD TOWN BOARD CHAIR OR CLERK. MINNESOTA STATUTES SECTIONS 435.193 THROUGH 435.195 AUTHORIZE TOWNS TO ADOPT PROCEDURES FOR DEFERRING ASSESSMENTS FOR HOMESTEAD PROPERTIES IN CERTAIN CIRCUMSTANCES WHERE THE ASSESSMENT WOULD WORK A HARDSHIP. COTTONWOOD TOWN, HOWEVER, HAS NOT ADOPTED ANY SUCH DEFERMENT STANDARDS OR GUIDELINES.

It is Ordered and Notice is given that on September 16, 2019, 2019, at 10:00 a.m., a hearing will be held in this Court at New Ulm, Minnesota, on a petition for the formal probate of an instrument purporting to be the Decedent’s Will dated March 14, 2011, and for the appointment of Doris M. Biser and Kenneth F. Biser, whose address is 244 Stardust Blvd., Circle Pines, Minnesota 55014, as co-personal representatives of the Decedent’s estate in an unsupervised administration.
Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the co-personal representatives will be appointed with the full power to administer the Decedent’s estate, including the power to collect all assets; pay all legal debts, claims, taxes, and expenses; sell real and personal property; and do all necessary acts for the Decedent’s estate.
Notice is further given that, subject to Minn. Stat. 524.3-801, all creditors having claims against the Decedent’s estate are required to present the claims to the personal representative or to the Court within four (4) months after the date of this notice or the claims will be barred.
