ORDINANCE NO. 19-031, FIFTH SERIES CITY OF NEW ULM, BROWN COUNTY, MINNESOTA

AN ORDNANCE AMENDING SECTION 7.04 OF THE CITY CODE OF THE CITY OF NEW ULM RELATIVE TO SNOW REMOVAL IN MUNICIPALLY OWNED PARKING LOTS.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM:

SECTION I. That Section 7.04 of the City Code of the City of New Ulm is hereby amended to add the following:

Subd. 3. Parking on municipally owned property after snowfall. Upon providing at minimum forty-eight hours notice, the City may direct that any vehicle otherwise lawfully parked, left standing, or left unattended on any municipally owned property or parking lot be removed from said property or parking lot for the purposes of necessary snow removal.

A. Said notice must contain the specific date and time period during which the vehicle must be removed from the municipally owned property or parking lot and said notice must state that the vehicle needs to be removed for the purposes of snow removal. The notice must also contain a warning that failure to remove the vehicle from the municipally owned property or parking lot may subject the vehicle to removal, towing, and impoundment’s.

B. Said notice may be accomplished by orally informing the registered owner of the vehicle or the individual entity leasing a municipally owned parking space. Said notice may also be accomplished by hand delivering or mailing, by first class mail, written notice to the last known address of the registered owner of the vehicle or to the last known address of the individual or entity leasing the parking space. If notice is mailed, the forty-eight hour time period will begin at Noon on the day following the date the notice was placed in the mail.

C. Notice may also be accomplished by placing written notice under the windshield of the vehicle or upon any other appropriate location on the vehicle.

D. Failure to remove any such vehicle in accordance with this Section may subject the vehicle to removal, towing, and impoundment pursuant to Section 7.75.

SECTION II. That this ordinance shall take effect and shall be in force 30 days from and after its adoption, approval, and publication.
