Brown County District Court

• Two counts of gross misdemeanor DWI and misdemeanor driver must carry proof of insurance when operating vehicle charges were filed Jan. 27, 2023 against Erik Melgar, 29, 237 Crosby Ave. N.E., Madelia.

According to court documents, Brown County Sheriff’s Office deputies Eric Schwarzrock and Justin Bauer responded to a vehicle in the ditch on CR 29, east of 205th Ave. at 9:15 p.m. Jan. 15, 2023. Deputy Schwarzrock saw an Infinity M37 sedan completely off the road, facing west in the westbound ditch.

Melgar was identified as the driver. He said he was driving from Madelia to New Ulm on CR 29 and showed intoxication clues. He failed certain field sobriety tests and refused to complete a preliminary breath test and was arrested for suspicion of DWI and transported to the Brown County Jail. He agreed to take a DataMaster breath test that registered a 0.21 blood alcohol content at 10:41 p.m.
