Court Proceedings

Brown County District Court

• Two second-degree DWI charges, misdemeanor failure to change name or address on driver’s license and failure to yield to pedestrian and petty misdemeanor stop sign violation charges were filed Oct. 13, 2021 against Nicole J. Dittrich, 23, 609 Payne St. S., New Ulm.

According to court documents, New Ulm Police Sgt. Charles Rasche was parked in a parking lot at 1st Street S. and Broadway at 1:39 a.m. Oct. 2 monitoring the stop sign at the intersection when he saw a pedestrian that was walking north on the east sidewalk and cross 1st Street S.

As the pedestrian was nearly through the crosswalk, Rasche saw a white midsize Chevrolet travel west, approaching the intersection rapidly, and ran the stop sign. The car appeared to brake late, nearly hitting the pedestrian and continued into the intersection, appearing to speed up and continue west.

Rasche stopped the vehicle and Dittrich admitted to not seeing the stop sign. Rasche noticed her driver’s license address was old and asked her about it. She said she bought a house and was living at the new address for about a year. Rasche noticed Dittrich seemed intoxicated. She admitted to drinking alcohol earlier in the night.

Dittrich failed field sobriety tests and a preliminary breath test, was arrested and transported to the Brown County Law Enforcement Center. She provided a breath sample for analysis at 2:21 a.m. that read .18 grams of alcohol concentration per 210 liters of breath.

Dittrich has a prior impaired driving conviction from Jan. 5, 2020 in Benton County and a prior impaired driving loss of license from Jan. 12, 2020.
