• Ricky Pacheco, 42, Fresno, Ca., was charged with gross misdemeanor 2nd degree refusal to submit to chemical test and 3rd degree DWI May 14. According to court documents, New Ulm Police wer on patrol at 1:34 a.m. May 14 when their attention was drawn to a vehicle traveling in front of them headed east on 20th South Street, near the Valley Street intersection. Police observed that the vehicle had no taillights illuminated. Police stopped the vehicle, identified the driver as Pacheco and detected a strong odor of alcohol coming from the vehicle. Pacheco appeared to be lethargic, with slow speech, watery, bloodshot eyes and heavy eyelids. Two passengers in the vehicle appeared to be intoxicated. All three people denied consuming alcoholic beverages. Pacheco failed certain field sobriety tests, a preliminary breath test and was arrested. He said he would take a breath test at the Law Enforcement Center but did not blow satisfactorily and failed to follow instructions. His driving record showed a qualified prior impaired driving incident, a DWI conviction on Oct. 15, 2013 in California.
