NEW ULM The Conditional Use Permit application from Haala Real Estate for mining near North Garden and Lee streets will return to the Planning Commission at today's meeting.
The commission tabled a decision on the CUP last month. The request, which came from Tom Haala on behalf of Haala Real Estate, would allow the commercial excavation of natural materials from property at 1301-1417 N. Garden St. and 1201-1227 Elm St.
During a public hearing at the July meeting, neighboring residents expressed concerns about the management of storm water, harmful dust particles and potential damage to public rights-of-way.
The Commission felt additional documentations would be needed before any permit was approved. Commissioner James Hogen specifically asked for a drainage plan.
Community Development Director David Schnobrich stated that City Staff recommended the preparation of several documents prior to approval.
The documents would need to show the development and implementation of a drainage and conveyance plan to deal with the storm water that discharges across the property. In addition, the documents must specify development of an operational plan that addresses site security, traffic circulation, project schedule for mining, impact to public rights-of-way, mining methods, buffer areas and reclamation plans. The applicants would also need to secure a storm water permit from the City and a construction activity permit from the Minnesota Pollution Control Association.
In another matter, the commission will consider a petition from Elaine Paa to zone property petitioned for annexation as General Industrial District.
The property, which is located south and west of County State Aid Highway 29/North Garden Street and northwest of North Highland Avenue, is in Milford Township. The property totals 9.98 acres and is primarily used for farming. If approved, the request would allow the land to be purchased by the August Schell Brewing Company. Annexation of the property will be considered during the Sept. 2 City Council meeting.
