TIVE TO LICENSING
AND PERMITTED
LOCATION OF COM-
MERCIAL KENNELS
BE IT ORDAINED BY
THE CITY COUNCIL
OF THE CITY OF
NEW ULM:
SECTION I. That Sub-
division 3 of Section
4.59 of the City Code
of the City of New
Ulm is hereby amend-
ed to read as follows:
Subd. 3. Restriction.
No commercial kennel
shall be licensed at a
location other than as
permitted by chapter 9
of this City Code.
Commercial Kennels
shall be subject to the
regulations set forth in
Section 9.14, Subdivi-
sion 7 of this City
Code.
SECTION II. That
Subdivision 9 of Sec-
tion 8.21 of the City
Code of the City of
New Ulm is hereby
amended to read as
follows:
Subd 9. Number of
dogs.
A. No person shall
keep or allow to be
kept at any one loca-
tion within the City
more than 3 dogs. Pro-
vided, however, that
such limitation does
not apply to:
1. A City owned or
operated dog pound;
2. A licensed veteri-
narian;
3. A commercial ken-
nel licensed by the
City under Section
4.59 of this City Code;
or
4. A litter of pups for a
period not to exceed
90 days after birth.
SECTION III. That
Subdivision 10 of Sec-
tion 8.21 of the City
Code of the City of
New Ulm is hereby
amended to read as
follows:
Subd. 10. Resident
occupant. No person
shall keep any number
of dogs at a location
within the City except
on a parcel or lot
where there is a
resident occupant, ex-
cept for such locations
that are:
A. a City owned or
operated dog pound;
B. a licensed veteri-
narian; or
C. a commercial ken-
nel licensed by the
City under Section
4.59 of this City Code.
SECTION IV. That
Subdivision 12 of Sec-
tion 8.21 of the City
Code of the City of
New Ulm is hereby
amended to read as
follows:
Subd. 13. Location
of Kennel. No com-
mercial kennel shall be
located in any zoned
residential district.
SECTION V. That
Section 9.03 of the
City Code of the City
of New Ulm is hereby
amended by adding
thereto the following
Subdivision 72:
Subd. 72. The term
"commercial kennel"
means a facility con-
ducted as a business
and licensed by the
City under Section
4.59 of this City Code
for the boarding,
breeding, raising,
grooming, selling,
training, or other an-
imal husbandry activi-
ties for dogs, cats, or
other household pets.
SECTION VI. That
Subdivision 2 of Sec-
tion 9.12 of the City
Code of the City of
New Ulm is hereby
amended by adding
thereto the following
Paragraph U:
U. Commercial ken-
nels.
SECTION VII. That
the Subdivision 2 of
Section 9.13 of the
City Code of the City
of New Ulm is hereby
amended by adding
thereto the following
Paragraph M:
M. Commercial ken-
nels.
SECTION VIII. That
Section 9.14 of the
City Code of the City
of New Ulm is hereby
amended by adding
thereto the following
Subdivision 7:
Subd 7. Commercial
kennel regulations.
A. All buildings occu-
pied by a commercial
kennel shall be located
at least one thousand
(1,000) feet from the
boundary of any
residential zoning dis-
trict except the R-A
(Agricultural
Residence) zoning dis-
trict.
B. The commercial
kennel shall be suffi-
ciently insulated so
that no unreasonable
noise or odor can be
detected off the prem-
ises.
C. Accessory use to a
commercial kennel
may include retail
sales of products for
or related to household
pets, as long as the
accessory use does
not occupy more than
25 percent of the total
gross floor area of the
principal building.
SECTION IX. That
this ordinance shall
take effect and shall
be in force 30 days
from and after its
adoption, approval,
and publication.
