WHEREAS, Theron

Manager for Menard,
Inc., has filed an appli-
cation for a variance
from the City Code to
allow Outlot A and
Outlot B to be platted
as part of the Menard
Subdivision without
frontage on a public
street. The subject
property is legally
described as the SE
1/4 of the SE 1/4 ex-
cept the West 140'
thereof, Section 14,
Township 110, Range
31 (Street Address:
2116 Westridge Road).
WHEREAS, the City
Code requires that this
matter be considered
by the New Ulm Board
of Zoning Adjustment.
NOW, THEREFORE,

justment will meet on

WHEREAS, Brian
Gramentz, City
Manager of the City of
New Ulm, Minnesota,
has filed an application
with the City of New
Ulm requesting a Con-
ditional Use Permit for
the purpose of con-
structing a flood levee
adjoining the Minneso-
ta River from 9th
South Street to the
east-west alley
between 19th and 20th
South Streets. The
Permit would authorize
the following:
1. The placement of fill
for the construction of
a levee or structural
works in the Floodway
District of the Min-
nesota River.
2. The placement of fill
in excess of 500 cubic
yards on parcels of
property in the Flood
Fringe District of the
Minnesota River.
The flood levee will not
cause an increase in
the 100 year flood
stage of the Minnesota
River at the project lo-
cation and will be si-
tuated on the property
legally described as
Lots 5-7, Block 1,
Fritsche Farm Addi-
tion; Balance of Outlot
B, Section 28-110-30;
Lots 1-7, Block 1,
Front Street Estates;
Sublot 1 of Outlot C;
Lot 7, Block 13 South
of Center St.; Lots

BE IT RESOLVED,
pursuant to the City
Code, the New Ulm
Planning Commission
will meet at 4:30 P.M.
on Thursday, De-
cember 29, 2011 in the
City Hall Council
Chambers, 100 North
Broadway, New Ulm,
Minnesota to consider
this matter. The public
and all interested par-
ties are hereby notified
