for public inspection at
the City Clerk-
Treasurer's office.
Written or oral objec-
tions will be con-
sidered at the public
hearing. No appeal
may be taken as to
the amount of an as-
sessment unless a
signed, written objec-
tion is filed with the Fi-
nance Director/City
Clerk-Treasurer prior
to the hearing or
presented to the
presiding officer at the
hearing.
After the public hearing
the City Council may
adopt the proposed
special assessment
roll. You will have 30
days from the adoption
date to pay the entire
final special assess-
ment amount without
interest to the Brown
County Auditor-
Treasurer's Office.
After such time, you
may pay to the County
Auditor the entire
amount of the assess-
ment remaining un-
paid, plus the interest
accrued to December
31st of the year in
which such payment is
made. Such payment
to the County must be
made before No-
vember 15th or in-
terest will be charged
through December
31st of the succeeding
year. The unpaid bal-
ance of any assess-
ment will be levied by
Brown County and will
be collected as an as-
sessment on your pro-
perty tax statement
over a ten (10) year
period along with a
4.40% percent simple
interest charge on the
unpaid balance.
An owner may appeal
an assessment to dis-
trict court pursuant to
Minnesota Statutes
Section 429.081 by
serving notice of the
appeal upon the Mayor
or Finance Director/
Clerk-Treasurer of the
of the City within 30
days after the adoption
of the assessment and
filing such notice with
the district court within
ten days after service
upon the Mayor or Fi-
nance Director/Clerk-
Treasurer.
Under Minnesota Sta-
tutes 435.193 to
435.195 the Council
may, in its discretion,
defer the payment of
this special assess-
ment for any home-
stead property owned
by a person 65 years
of age or older for
whom it would be a
hardship to make
these payments.
When deferment of the
special assessment
has been granted and
is terminated for any
reason provided by
law, all amounts accu-
mulated plus applica-
ble interest become
due. Any assessed
property owner meet-
ing the requirements of
this law and City Code
Section 2.80 adopted
under it may, within 30
days of the confirma-
tion of the assessment
apply to the Finance
Director/City Clerk-
Treasurer on such
forms as are
prescribed by the
County Auditor for
such deferral of pay-
ment of this special
assessment on his
property.
