SYNOPSIS OF COUNTY BOARD MEETING

October 19, 2010

Members present: Seeboth, Berg, Lochner, and Potter along with Administrator Enter and County Attorney Hinnenthal.

M/Potter, S/Berg, to accept the Minutes of 10-5-10 as revised and authorize publication of the Synopsis of same as revised, carried.

M/Lochner, S/Potter, to approve Res. No. 2010-29 accepting the resignation of District 3 County Commissioner Deborah Dove, carried.

M/Lochner, S/Potter, to authorize the payment of General Government claims in the amount of $151,743.92, carried.

M/Berg, S/Lochner, to approve seven (7) Drainage Ditch Repair requests, carried.

M/Potter, S/Lochner, to accept and file the update as presented by Auditor/Treasurer Helget on the JD #30 R&B Teleconference held at 8:30 AM this date that was attended by Commissioners Lochner and Potter, and Redwood County Commissioners, along with A/T Helget and Brown County Ditch Inspector Dale Holtz, and noted that the JD #30 R&B Authority approved to proceed with a west side ditch repair area in the estimated cost of $1,650 and an east side ditch repair area in the estimated maximum cost of $3,000 in Section 4 in Stark Township, carried.

M/Berg, S/Seeboth, to approve to increase the payment threshold for vendors listed in the 12-31-09 Brown County Published Financial Statements from $100 to $2,000 pursuant to Minnesota Statutes 375.12 and 375.17, carried.

M/Lochner, S/Potter, to approve revisions to Fund Balance Reporting and Government Fund Type Definitions per GASB 54 for financial statement preparation for the year ending 12-31-2011 going forward, carried. It should be noted the new Fund Balance Classifications would be Nonspendable, Restricted, Committed, Assigned, and Unassigned.

M/Berg, S/Potter, to approve revisions to the Capital Assets Policy to include definition and recognition of Intangible assets per GASB 51 for financial statement preparation for the year ending 12-31-10 going forward, carried.

M/Potter, S/Berg, to approve the Agreement for Consulting Services with Hildi Inc. in the amount of $4,200 for actuarial services relating to the determination of the GASB 45 OPEB liability needed for completion of the 12-31-10 Financial Statements, carried.

M/Berg, S/Potter, to approve the following Board Meeting dates for 2011: 1st, 3rd & 4th Tuesdays for the months of January, February, March, April, May, June, July, August, September, and October; the 1st, 3rd & 5th Tuesdays in November; and the 2nd & 4th Tuesdays in December, carried.

M/Lochner, S/Potter, to accept and order filed the September 2010 Monthly Reports of Activity for the Brown County Sheriff's Dept., carried.

M/Lochner, S/Berg, to approve the following premium rates for 2011 for the HealthPartners Health Plans: HP 2500/5000 HSA 100% Single $494.95 and Family $1,336.26; HP 500/1000 Single $649.44 and Family $1,753.33; and HP 300/600 Single $721.30 and Family $1,947.32 with payment of County share/employee share according to 2011 Personnel Policy and Union Contracts, carried.

M/Berg, S/Potter, to approve the appointment of Jason Ludewig as a Temporary Five (5) Month Position (commencing 11-15-10) Maintenance Worker III (Sleepy Eye Shop) for the Brown County Highway Dept. at the hourly rate of $16.2130 contingent on passage of the pre-placement physical and drug screen, carried.

Correspondence C-1 thru C-15 were accepted and filed.

Lochner reported on Area II, Detox, SCHA, and the Solid Waste Advisory Committee matters; and Potter reported on RCRCA meeting on 10-18-10.

M/Berg, S/Lochner, to approve the Conditional Use Permit (CUP) App. #C-00266 by Thomas Rose on property described as Outlot "B" of balance of SW4, Sec. 7-T109N-R30W, Cottonwood Twp. for the purpose of allowing use of a Sign & Decal making business, with two (2) conditions listed, carried.

M/Potter, S/Lochner, to approve the CUP App. #C-00265 by James & Susan Anderson on property described as part of the SE4, Sec.24-T109N-R34W, Burnstown Twp. for the purpose of renewing existing CUP #C-00165 to continue to allow use of an existing gravel mine to include crushing, screening & a hot mix plant, with three conditions listed, carried.

M/Potter, S/Berg, to approve CUP App. #C-00263 by Ladd Demolition & Aggregates on property described as part of the NE4, Sec. 13-T109N-R33W, Leavenworth Twp. for the purpose of renewing existing CUP #C-00168 to continue to allow use of gravel mine to include mining/extraction, crushing & hot mix plant, with five (5) conditions listed, carried.

M/Lochner, S/Berg, to approve Preliminary Plat #P-00121 a single lot split application by Frederick Tauer known as Tauer's Third Subdivision, on property described as part of the NE4, Sec. 23-T109N-R33W, Leavenworth Twp. Property being platted is currently a single building site to be split to allow sale of CRP land proposed south line to follow CRP, carried.

M/Potter, S/Lochner, to approve Res. No. 2010-30 requesting a Presidential Disaster Declaration for the September 22-23, 2010 storm event and resulting flooding, carried.

M/Berg, S/Lochner, to approve Res. No. 2010-31 requesting a Presidential Disaster Declaration for the Spring flooding events of March 2010, carried.

M/Lochner, S/Potter, to approve Res. No. 2010-32 requesting a Presidential Disaster Declaration for the Severe Storm event of June 25 & 26, 2010, carried.

Calendars were coordinated for the next two week period and the County Board reassigned committee memberships related to the resignation of Commissioner Dove.

M/Lochner, S/Berg, to approve the following Ordinance No. 2010-05 Repealing Brown County Ordinance for Body Art Parlors (to include tattooing and piercing) of October 24, 2000 pursuant to authority granted in laws of Minnesota, MN Statute 375.51 as amended: Brown County Ordinance No. 2010-05 AN ORDINANCE REPEALING THE BROWN COUNTY ORDINANCE FOR BODY ART PARLORS (to include tattooing and piercing) of OCTOBER 24, 2000. THE BROWN COUNTY BOARD ORDAINS IN ACCORDANCE WITH THE AUTHORITY GRANTED IN LAWS OF MINNESOTA, MINNESOTA STATUTE 375.51 AS AMENDED AS FOLLOWS: SECTION 1 REPEALER 101.0 REPEAL OF ORDINANCE FOR BODY ART PARLORS (to include tattooing and piercing). 101.1 The existing Brown County Ordinance for Body Art Parlors (to include tattooing and piercing) is hereby repealed. SECTION 2 EFFECTIVE DATE 201.0 EFFECTIVE DATE This Ordinance shall be in full force and effect from and after October 19, 2010 or the date of its passage and publication according to law, whichever occurs first. Dated this 19th day of October, 2010, carried.

M/Potter, S/Lochner, to authorize the payment of Family Services Administrative claims in the amount of $125,593.32, carried.

M/Berg, S/Potter, to approve Res. No. 2010-33 a South Country Health Alliance Resolution of Support to include Freeborn County as a non-member in the service network for the calendar year 2011, carried.

At 10:58 AM, Chairman Seeboth convened a Closed Session to consider Social Services Payments, whereupon M/Potter, S/Lochner, to authorize the payment of Social Services payments in the amount of $215,316.05, carried. The Closed Session ended at 11:04 AM.

M/Potter, S/Berg, to approve the revised Brown County Public Health (BCPH) Policy/Procedure titled: Performance Improvement, effective 10-19-10 as recommended by the Brown County Public Health Advisory Committee (BCPHAC), carried.

M/Berg, S/Lochner, to approve the revised BCPH Policy/Procedure titled: Healthy Food Policy, effective 10-19-10 as recommended by the BCPHAC, carried.

M/Lochner, S/Potter, to approve the revised BCPH Policy/Procedure titled: Family Health Resources, effective 10-19-10 as recommended by the BCPHAC, carried.

M/Berg, S/Lochner, to approve the BCPH Policy/Procedure titled: Immunization Policy, effective 10-19-10 as recommended by the BCPHAC, carried.

M/Lochner, S/Berg, to accept and file the following Public Health Update: The Public Health Standards; School Based Influenza Vaccine Clinic Update School Based Influenza Vaccine Clinic Update; Seasonal Influenza Vaccine Campaign; Disease Prevention and Control/Emergency Preparedness Staff; WIC Grant; Public Health Accreditation; Public Health Leadership Institute; Electronic Medical Record Progress; Lead Poisoning Prevention Month; and MACO Prescription Drug Program, carried.

There being no further business, Chairman Seeboth adjourned the Meeting at 11:23 AM.
