SYNOPSIS OF COUNTY BOARD MEETING

Members present: Seeboth, Berg, Dove, Lochner, and Potter along with Administrator Enter and County Attorney Hinnenthal.

M/Lochner, S/Potter, to accept the Minutes of 9-7-10 and authorize publication of the Synopsis of same, carried.

M/Berg, S/Dove, to schedule a Closed Session for labor negotiation strategy planning to be held in the Commissioners Room 204 of the Brown County Courthouse, New Ulm, MN at approximately 10:30 AM this date 9-21-10 for the two (2) AFSCME Collective Bargaining Units (Courthouse and Highway) pursuant to MS 13D.03, carried.

M/Dove, S/Berg, to authorize the payment of General Government claims as revised in the amount of $128,537.49, carried.

Chairman Seeboth appointed Commissioners Berg & Potter to an ad hoc committee to research a $1,660 CD#10 ditch maintenance bill with staff.

M/Berg, S/Potter, to authorize publication of the 2009 Annual Brown County Financial Report, carried.

M/Berg, S/Lochner, to accept and file the 2010 Third Quarter Report for the Brown County Assessor's Dept., carried.

M/Dove, S/Lochner, to accept a $350 donation from Thrivent Financial to the Brown County Juvenile Drug Court to be used for event related expenses (including meals, parking, travel, etc.) at the Twins Game "Recovery Works" event on Thursday 9-30-10, carried.

M/Potter, S/Berg, to accept and file the August 2010 Budget Report (Cash Basis and Unaudited) which reflects activity at 66.7% of the budget year as follows: expenditures of $17,259,112.39 or 60.7%, and revenues of $18,027,545.23 or 64.6%; and the August 2010 Supplemental Budgets Report noting expenditures of $913,024.21 or 49.2%, and revenues of $849,463.82 or 45.5% of annual budgeted activity, carried.

M/Berg, S/Seeboth, to accept and order filed the August 2010 Monthly Reports of Activity for the Brown County Sheriff's Dept., carried.

M/Lochner, S/Dove, to grant Joy Hoffmann, PHN/WIC, a leave of absence from Brown County Public Health for one month effective 9-2-10, carried.

M/Berg, S/Potter, to approve regular employee status for Annie Hillesheim, Intake Social Worker; Jessica Fischer, IT/Office Support Specialist; Jackie Nesvold, DD Social Worker; and Heidi Helget, Child Support Officer, carried.

M/Dove, S/Lochner, to approve the appointment of Linda Stevens as a FT Social Worker CD at the annual salary of $50,318 (Grade XIV, Step 12) effective 9-24-10, carried.

M/Dove, S/Potter, to accept and file the Certificate of Recognition that was presented to the Brown County Courthouse from the Minnesota Valley Action Council (MVAC) recognizing the Brown County Board of Commissioners for their dedication and participation in the MVAC's 2010 Summer Youth Program, carried.

M/Dove, S/Lochner, to approve the Preliminary Plat #P-00120 a multi (2) lot split application by Maria Jacobson known as Jacobson Woods Subdivision, on property described as part of the N2 of SE4 Sec. 4T110NR31W, Milford Twp. Property being platted is currently a building site to be split to allow new home construction, carried.

M/Lochner, S/Potter, to approve the Conditional Use Permit (CUP) App. #C-00261 by Daniel & Deanne Lendt on property described as part of the SW4, Sec. 15T110NR33W, Prairieville Twp. for the purpose of renewing CUP #C-00182 to expand from 814 AU up to 3,000 finishing hogs (900 AU) and 1,000 nursery (50AU) for a total of 4,000 head (950 AU) in a hog wean to finish operation. This is an expansion of the feedlot, using (1) 50'x104', (1) 38'x128', (1) 22'x92', and (1) 82'x200' existing hog barns with no new construction onsite, with seven (7) conditions listed, carried.

M/Berg, S/Lochner, to approve the CUP App. #C-00259 by Scott Rose on property described as part of the SE4, Sec. 31T111NR33W, Eden Twp. for the purpose of renewing CUP # C-8172 to continue to allow up to 630 AU (2100 head) in a hog wean to finish operation, with seven (7) conditions listed, carried.

M/Berg, S/Dove, to approve the CUP App. #C-00262 by Larry & Debra Fischer on property described as part of the NW4, Sec. 30T109NR31W, Sigel Twp. for the purpose of allowing the expansion of an existing feedlot from 292 AU (dairy) to up to 600 head beef finishing (600 AU), 50 head of mature dairy cattle (70 AU) and 50 dairy heifers (35 AU) for a total of 700 head (705 AU) in a beef finishing and dairy operation, with four (4) conditions listed, carried.

M/Lochner, S/Potter, to approve the State of MN Grant Contract #2000-14766 for the Hazard Mitigation Planning Grant with the MN Dept. of Homeland Security and Emergency Management in an amount not to exceed $45,000 (over a three year period); and authorize Board Chairman Seeboth to sign same on behalf of Brown County, carried. It was noted this grant will be used in updating the Brown County Hazard Mitigation Plan as required by the state.

At 10:35 AM, Chairman Seeboth convened a Closed Session for Labor Negotiation Strategy Planning pursuant to M.S.13D.03 for the two (2) AFSCME Collective Bargaining Units (Courthouse and Highway). This session was attended by Commissioners Seeboth, Berg, Dove, Lochner, and Potter along with County Administrator Enter, County Attorney Hinnenthal, Engineer Stevens, Personnel Director Crabtree, and Attorney Frank Madden via telephone (at 10:36 AM). The Closed Session adjourned at 10:55 AM.

M/Lochner, S/Berg, to authorize the payment of Family Services Administrative claims in the amount of $179,924.24, carried.

At 11:03 AM, Chairman Seeboth convened a Closed Session to consider Social Services Payments, whereupon M/Potter, S/Berg, to authorize the payment of Social Services payments in the amount of $228,936.55, carried. The Closed Session ended at 11:13 AM.

C-1 thru C-11 were accepted and filed.

Seeboth reported on the MCIT Risk Management Seminar on 9-9-10; Berg reported with Lochner on the AMC Policy Committee meetings and with Dove on MVAC; Lochner reported on Detox and SCHA; Dove reported with Potter on Extension and BCEDP, Inc.; and reported on the MRB meeting on 9-20-10, Dakota War Commemoration Committee, and Workforce Council; Potter reported on the AMC Policy Committee meeting and on the RCRCA meeting on 9-20-10.

Calendars were coordinated for the next two week period.

There being no further business, Chairman Seeboth adjourned the Meeting at 11:23 AM.
