SYNOPSIS OF COUNTY BOARD MEETING

Members present: Seeboth, Berg, Dove, Lochner, and Potter along with Administrator Enter and County Attorney Hinnenthal.

M/Potter, S/Lochner, to accept the Minutes of 8-24-10 and authorize publication of the Synopsis of same, carried.

M/Berg, S/Dove, to authorize the payment of General Government claims in the amount of $136,646.51, carried.

M/Berg, S/Potter, to schedule a Public Hearing for 11:15 AM on 9-28-10 for the purpose of setting assessments/liens to Brown County drainage ditches that have deficit balances or insufficient funds in their accounts for proper maintenance and repair, carried.

M/Lochner, S/Potter, to accept and file the Cash Management/Investment Report for the month of August which reflects a county investment portfolio balance of $15,846,863.79 as of 8-31-10, carried.

County Administrator Enter presented the draft 2011 Brown County budget, reporting that adjusted total draft 2011 budgeted expenditures in the amount of $26,515,413 reflect a decrease of 6.7% from the 2010 budget of $28,429,507. The County Board reviewed the state levy limit regulations. M/Potter, S/Dove, to establish the 2011 proposed property tax levy for certification to the County Auditor/Treasurer in the amount of $11,427,170 which represents an increase of 5.0% over the total 2010 certified levy, carried. It was further noted that the final 2011 budget and levy will be adopted by the County Board in December.

M/Lochner, S/Berg, to approve the "Payable 2011 PT Form 280" as drafted for submission to the MN Dept. of RevenueProperty Tax Division, carried.

M/Lochner, S/Dove, to schedule a Public Hearing on the proposed 2011 county budget and levy for 6:00 PM on Wednesday 12-1-10 in the District Courtroom located on the 3rd floor of the Brown County Courthouse and to revise the start of the regular County Board meeting on 12-1-10 to 4:00 PM, carried.

M/Dove, S/Berg, to accept and file the Certificate of Appreciation that was presented to the Brown County Board from the Brown-Nicollet-Watonwan (BNW) County Drug Court recognizing the Board of Commissioners for their continued support of the BNW County Drug Court Program, carried.

M/Lochner, S/Berg, to approve Res. No. 2010-21 whereby Brown County agrees to act as sponsor for the City of Sleepy Eye in a Bike Trail Project submittal for Federal Enhancement Funds to construct a bike trail outside of the west shoulder of Trunk Highway 4 between the ends of the existing bike trail, carried.

M/ Lochner, S/Potter, to approve Res. No. 2010-22 whereby Brown County agrees to act as sponsor for the City of Sleepy Eye in a Railroad Crossing Project submittal for Federal Safety Funds to construct a new railroad crossing at 12th Avenue NE in Sleepy Eye, carried.

M/Potter, S/Dove, to approve Res. No. 2010-23 approving final acceptance of the SP 008-611-018 Project for Replacement of Bridge #7090 and approach grading on CSAH 11 over the Cottonwood River using federal and state funding, carried.

M/Berg, S/Potter, to approve final payment to B&H Petroleum in the amount of $2,622.58 for the replacement of the fuel dispensing system at the Highway Dept., carried.

The County Board reviewed the 8-24-10 decision to advertise to fill a five month Highway Dept. Maintenance Worker position in the Sleepy Eye Shop and by consensus, reaffirmed the County Board action of 8-24-10.

M/Berg, S/Dove, to approve regular employee status for Amanda O'Connor, PT PHN/MCH, carried.

M/Dove, S/Lochner, to approve the low quote received from Treat's Home Center in the amount of $3,040.95 (sales tax included) for replacement of carpet in the Brown County Public Health WIC Clinic/Office area of the Community Services Building with Federal WIC funding to pay nearly all of the re-carpeting cost, carried. An additional quote was received from New Ulm Furniture Co.

M/Berg, S/Potter, to approve the Settlement AgreementStep 3 Grievance Overtime Benefit with LELS Local #94, carried.

Correspondence C-1 thru C-7 were accepted and filed.

Berg reported on the South Central Regional Radio Board, EMS, and with Potter on the Ditch meeting on 9-1-10; and Lochner reported on AREA II matters.

Calendars were coordinated for the next two week period.

M/Berg, S/Dove, to approve the 2011-2015 recycling contract for the communities of New Ulm, Hanska, Searles, Essig and surrounding rural areas with River View Sanitation, Inc., New Ulm, MN at a total contract cost of $213,984.00 for 2011, carried.

M/Potter, S/Lochner, to approve the 2011-2015 recycling contract for the communities of Sleepy Eye, Springfield, Cobden, Evan and Comfrey and surrounding rural areas with Braun & Borth Sanitation, Inc., Sleepy Eye, MN at a total contract cost of $120,333.79 for 2011, carried.

M/Potter, S/Dove, to approve Res. No. 2010-24 approving Property Tax Abatements for the MAT Industries Expansion Project in Springfield, MN, carried.

At 11:05 AM, Chairman Seeboth recessed the Regular Meeting for lunch and until the 1:15 PM County Board appointment.

At 1:15 PM, Chairman Seeboth reconvened the Regular Meeting at which time Great River Energy Project Communications Coordinator Randy Fordice and Routing Lead Dan Lesher met with the County Board. Approximately twelve (12) Eden Township citizens including Representative Paul Torkelson also were in attendance. Mr. Fordice and Mr. Lesher reviewed the steps taken to date to acquire the state permit for the CapX2020 Brookings County-Hampton 345 kV transmission line project. It was noted that the MN PUC is expected to issue its order approving the transmission line route through Eden Township very soon. Thereafter, Minnesota Statutes 216B.27 allows an aggrieved person up to twenty (20) days to request a rehearing before the MN PUC. M/Lochner, S/Berg, to support the pending request of Eden Township area citizens to the MN PUC for a rehearing on the approved route which is different from the original proposed route, and in the process give opportunity for all positions and viewpoints to be heard and considered by the MN PUC as it makes final determination of the 345 kV transmission line route through Eden Township, Brown County, carried.

There being no further business, Chairman Seeboth adjourned the Meeting at 2:10 PM.
