SYNOPSIS OF COUNTY BOARD MEETING

June 1, 2010

Members present: Seeboth, Berg, Dove, Lochner, and Potter, along with Administrator Enter and County Attorney Hinnenthal.

M/Lochner, S/Potter, to accept the Minutes of 5-25-10 and authorize publication of the Synopsis of same, carried.

M/Berg, S/Potter, to authorize the payment of General Government claims as revised in the amount of $79,093.15, carried.

M/Lochner, S/Berg, to approve one (1) Drainage Ditch Repair request in Home Twp., carried.

M/Potter, S/Lochner, to approve one (1) Drainage Ditch Repair request in Albin Twp., carried.

M/Lochner, S/Potter to accept and file the report provided by A/T Helget on the JD#30 R&B Joint Drainage Ditch Authority Meeting that is scheduled for 1:30 PM this date in the Government Office Building in Sleepy Eye, MN to consider the alternatives for the Bridge #2 located in Section 25 of Prairieville Township; and noting that Potter and Lochner will be representing Brown County on the JD#30 R&B Joint Ditch Authority, carried.

M/Berg, S/Lochner, to approve licenses for the following establishments in Brown County for a period of one year from 7-1-10 to 6-30-11: City Limits, Sleepy Eye: On Sale Liquor License-$1,200 and Sunday Liquor License-$200; Carl's Corner, Essig: On/Off Sale Liquor License-$1,300 and Sunday Liquor License-$200; Searles Bar & Grill, Searles: On/Off Sale Liquor License-$1,300 and Sunday Liquor License-$200; and 3.2 Percent On Sale License-$20 each for: Sleepy Eye Golf Club, Sleepy Eye; Stark Baseball Association; Searles Baseball Association; Sigel Athletic Association; Leavenworth Baseball Association; Church of Japanese Martyrs; Flying Dutchmen Cycle ClubCottonwood Twp.; and Essig Baseball Association: 3.2 Percent On/Off Sale License-$40, carried.

M/Potter, S/Seeboth, to approve Tobacco Licenses for the following establishments in Brown County for a period of one year from 7-1-10 to 6-30-11: Hanska Municipal Liquor Store, Hanska; Ampride/Farmers Cooperative of Hanska, Hanska; Ridin' High Saloon, Cobden; MaMa G's, Evan, carried.

M/Dove, S/Seeboth, to approve renewal of the Adult Basic Education Cooperative Contract with Mankato Life Lines Consortium and Brown County for the period of 7-1-10 thru 6-30-11, with said contract providing a General Education Degree (GED) Program for inmates at a county cost not-to-exceed $6,329, carried.

M/Dove, S/Lochner, to approve the appointment of Tammy Johnson as the Regular PT (average 20 hrs/wk) Juvenile Crew Leader for the Probation Dept., at the hourly rate of $17.3660 (Grade XI, Step 3) and with a projected start date of 6-15-10, carried.

M/Berg, S/Potter, to accept the resignation of Robin Bandow as Reg. PT Homemaker for the Public Health Dept. effective 5-31-10, carried.

M/Lochner, S/Potter, to approve regular employee status for Greg Mehlhop and Marvin Braun, both Regular PT Bus Drivers, and Melissa Hoffmann, FT Universal Contact/Ship RN, carried.

M/Lochner, S/Berg, to approve an amount of $18,000 annual support from Landfill Fund 60 to pay part of the Sentence-to-Service Contract cost to the State of MN, carried.

M/Berg, S/Potter, to approve and authorize the County Board Chair to send a written notice as per MN Statutes to Charles Kotten with respect to the Conditional Use Permit Application #C-00242 denial by the County Board of Commissioners on 5-25-10, carried, with Lochner dissenting.

M/Dove, S/Berg, to accept the proposal from River City Data, Inc. in the amount of $31,900 for the Aperture Card Scanning Conversion Project, with this project funded by the Recorder's Tech Fund, carried. Additional bids were received from the following: Mid America Business Systems; Indigital; FINTI, Inc.; Active Data System.

At 10:00 AM, Chairman Seeboth convened a Public Hearing for Revisions to Environmental Health Program Ordinances administered through the Brown-Nicollet Community Health Board as follows: 1) Ordinance Providing for the Regulation of Food and Beverage Establishments; 2) Ordinance Providing for the Regulation of Manufactured Home Parks, Recreational Camping Areas and Youth Camps; 3) Ordinance Providing for the Regulation of Public Swimming; 4) Ordinance Providing for the Regulation of Lodging Establishments. No members of the general public attended the public hearing. It was noted that public hearing notice affidavits of publication were on file. There being no public testimony, M/Lochner, S/Dove, to approve Brown County Ordinance No. 201001 Providing for the Regulation of Food and Beverage Establishments, which is an Ordinance Providing for the Licensing and Inspection of Restaurants and Places of Refreshment and Similar Food Service; Regulating Their Design, Construction, Operation and Maintenance and Providing for the enforcement of this Ordinance and the fixing of penalties throughout the entirety of Brown County. This Ordinance is applicable to all food and beverage establishments such as restaurants, boarding houses, and places of refreshment as defined in MN Statutes Chapter 157, and shall include temporary and push cart commissaries, drive-ins, bars, taverns, drive-in cafes, clubs, lodges, eating facilities at resorts, schools, public buildings and churches, except as exempted by MN Statute Chapter 157, Section 157.22 and all other businesses and establishments where meals, lunches, or drinks are served. In addition, this ordinance serves as criteria for evaluation of food and beverage service facilities in youth camps as defined in MN Statute Chapter 144, Section 144.71, subdivision 2. The requirements contained in this Ordinance are intended to be comparable to the MN Dept. of Health (MDH) Rules and are intended to meet the minimum requirements set forth by the MDH. Whenever the MDH amends rules or adopts new rules setting more restrictive sanitary standards than the ones established in this ordinance, the rules set by the MDH shall govern and will be considered in the enforcement procedure as part of this Ordinance, carried.

M/Berg, S/Potter, to approve Brown County Ordinance No. 201002 Providing for the Regulation of Manufactured Home Parks, Recreational Camping Areas and Youth Camps, which is an Ordinance providing for the licensing and inspection of Manufactured Home Parks, Recreational Camping Areas and Youth Camps; regulating their design, construction, operation and maintenance and providing for the enforcement of this Ordinance to prevent the transmission of communicable diseases and to promote the general welfare of the public. The requirements contained in this Ordinance are intended to be comparable to the MN Dept. of Health (MDH) Rules and are intended to meet the minimum requirements set forth by the MDH. Whenever the MDH amends rules or adopts new rules setting more restrictive sanitary standards than the ones established in this ordinance, the rules set by the MDH shall govern and will be considered in the enforcement procedure as part of this Ordinance, carried

M/Potter, S/Lochner, to approve Brown County Ordinance No. 201003 Providing for the Regulation of Public Swimming Pools, which is an Ordinance Providing for the Licensing and Inspection of public pools; regulating their design, construction, operation and maintenance and providing for the enforcement of this ordinance and the fixing of penalties throughout the entirety of Brown County. The purpose and intent of this Ordinance is to provide a standard for the design, construction, operation and maintenance of public swimming pools so that public health and safety will be maintained. This ordinance is applicable to all public swimming pools as defined in MN Rules Chapter 4717, and provides for the licensing and inspection of all public swimming pools; regulation of the design, construction, operation and maintenance of such pools; and the enforcement of violations of this ordinance. This ordinance is not applicable to a private residential swimming pool, defined as any swimming pool located on private property under the control of the homeowner, the use of which is limited to swimming or bathing by members of their family or their invited guest. (The design, construction, and operation of such pools are not subject to the provisions of MN Rules Chapter 4717), carried.

M/Berg, S/Dove, to approve Brown County Ordinance No. 201004 Providing for the Regulation of Lodging Establishments, which is an Ordinance providing for the Inspection and Licensing of Hotels, Motels, Lodging Establishments, and Resorts; regulating their design, construction, operation, and maintenance, and providing for the administration and enforcement thereof. The purpose of this Ordinance is to establish standards for all lodging establishments and to protect the health, safety and general welfare of the people of Brown County, including the following general objectives: Provide a minimum standard for the design, construction, operation and maintenance of lodging establishments; correct and prevent conditions that may adversely affect persons utilizing lodging establishments; and meet consumer expectations for the quality and safety of lodging establishments. This Ordinance provides for the licensing and inspection of all lodging establishments; regulation of the design, construction, operation and maintenance of such establishments; and the enforcement of violations of this ordinance. This Ordinance is applicable to all lodging establishments, such as hotels, motels, lodging houses, bed and breakfasts, and resorts as defined in MN Statute Chapter 157, carried.

Correspondence C-1 thru C-12 were accepted and filed.

Berg reported on EMS and on the South Central Regional Radio Board; Potter reported on the Highway Committee meeting; Seeboth reported on the Get Motivated seminar.

M/Lochner, S/Dove, to approve Memorandum of Agreement between County of Brown and Law Enforcement Labor Services, Inc. Locals #94 & #98 as pertains to the respective Labor Agreements for the term of 1-1-10 thru 12-31-11, carried.

By consensus the Board agreed to reserve the following dates for County Board appointments with department heads and appropriation agency representatives to review the proposed 2011 budget: Tues. Aug. 10, 1:00-4:00 PM; Wed. Aug. 11, 9:00 AM -3:00 PM; Fri. Aug. 13, 9:00 AM -3:00 PM.

M/Potter, S/Berg, to approve the request from the Sons of the American Legion for a County Road/Street closure of CSAH 3 (Central Street) between Marshall Avenue and O'Connell Avenue in the City of Springfield in conjunction with Riverside Days in Springfield scheduled to be held 6/25-27/10, carried.

M/Berg, S/Dove, to accept and file the Highway Dept. Monthly Update as follows: 2010 Construction Projects Update; Maintenance Projects Update, carried.

Calendars were coordinated for the next two week period.

There being no further business, Chairman Seeboth adjourned the Meeting at 10:28 AM.
