SYNOPSIS OF COUNTY BOARD MEETING
April 20, 2010
Members present: Seeboth, Berg, Dove, Lochner,
and Potter, along with Administrator Enter and
County Attorney Hinnenthal.
M/Lochner, S/Berg, to accept the Minutes of
4-6-10 and authorize publication of the Synopsis
of same, carried.
M/Lochner, S/Berg, to authorize the payment
of General Government claims in the amount of
$91,125.17, carried.
M/Berg, S/Dove, to authorize eight (8) Drainage
Ditch Repair requests, carried.
M/Lochner, S/Potter, to establish an Absentee
Ballot Board for 2010 and to approve the
appointment of the following staff members in
the Auditor/Treasurer Office to the Absentee
Ballot Board for both the 2010 Primary and
General Elections: Jean Prochniak, Cindy Meyer,
Steve Rutscher, Ruth Hansen, Pauline Braulick,
and Resa Harris, carried.
M/Berg, S/Dove, to accept and file the lists of
the top fifty taxpayers in Brown County, carried.
M/Lochner, S/Dove, to authorize Jail
Administrator Mathiowetz to sign a letter of
acknowledgement to allow the jail food service
vendor the use of the jail kitchen facility to
prepare meals for the Minnesota River Valley
Juvenile Detention Center and the Brown County
Evaluation Center-Detox, with the understanding
Brown County would be compensated at the rate
of $.50/meal and the meal rate would be adjusted
annually using the CPI as a guide, carried.
M/Berg, S/Lochner, to accept and file the STS
Adult and Juvenile Work Crew Reports for the 1st
Quarter of 2010, carried.
M/Dove, S/Potter, to accept and file the 2010
1st Quarter (Cash Basis and Unaudited) Budget
Report which reflects activity at 25% of the budget
year as follows: Expenditures of $5,928,822.15 or
20.9%, and revenues of $4,038,938.99 or 14.2%;
and the 2010 1st Quarter Supplemental Budgets
Report noting expenditures of $298,004.74 or
16.1%, and revenues of $196,388.07 or 10.5%
of budgeted activity, carried.
M/Lochner, S/Berg, to approve the Labor
Agreement between County of Brown and Law
Enforcement Labor Services, Inc. (LELS) Local
#94 Licensed Essential Employees of the Brown
County Sheriff's Dept. Collective Bargaining Unit
for the term of 1-1-10 thru 12-31-11, carried.
M/Potter, S/Dove, to approve the Labor
Agreement between County of Brown and LELS
Local #98 Non-Licensed Essential Employees
of the Brown County Sheriff's Dept. Collective
Bargaining Unit for the term of 1-1-10 thru 12-
31-11, carried.
M/Berg, S/Lochner, to approve the FY 2010
State of MN Board of Water and Soil Resources
Natural Resources Block Grant Agreement in the
amount of $9,931 for the period of 7-1-09 thru 6-
30-11 and authorize Board Chairman Seeboth to
sign same on behalf of Brown County, carried.
M/Lochner, S/Potter, to accept the quote
received from T.M. Fitzgerald & Associates in the
amount of $3,714.44 (includes sales tax) for the
purchase of 201 additional curbside recycling
bins as recommended by the Solid Waste
Advisory Committee, carried, with Seeboth
dissenting. Additional quotes were received from
the following: Busch Systems for 400-21 gallon
rectangular red bins; and Resourceful Bag & Tag
for 50021 gallon rectangular red bins.
M/Lochner, S/Dove, to approve the Conditional
Use Permit (CUP) App. #C-00237 Application
by Glen & Lisa Schuster on property described
as part of N2 of SE4 Sec. 15T110NR32W,
Home Twp., Brown County for the purpose of
allowing an existing operation to be used as a
contractors yard for railroad construction, repair
& maintenance & selling of railroad construction
equipment & parts, with nine (9) conditions listed,
carried.
M/Berg, S/Potter, to approve the CUP
App. #C-00243 Application of Christensen Farms
by Adam Barka on property described as part of
the SW4 of NE2 Sec. 36T108NR31W, Lake
Hanska Twp., Brown County for the purpose of
renewing CUP # 8050 to continue to allow up
to 624 AU (2080 head) in a hog wean to finish
operation, with seven (7) conditions listed,
carried.
M/Potter, S/Lochner, to approve the CUP App.
#C-00245 of Christensen Farms by Adam Barka
(current owner Gilbert Anderson) on property
described as part of the NW4 of SW4 Sec. 11
T109NR34W, Burnstown Twp., Brown County
for the purpose of renewing & amending CUP
#7406 to change name to reflect new ownership
& continue to allow use of a 624 AU (2080 head)
hog finish operation, with seven (7) conditions
listed, carried.
M/Berg, S/Lochner, to approve the
CUP App. #C-00240 by Brown County Highway
Department on property described as Lot M of
NW4 of NE4, Sec. 3T109NR32W, Stark Twp.,
Brown County for the purpose of renewing
CUP #C-00157 allowing continued use of an
existing gravel mine to include gravel screening,
processing and hot mix plant in A-1 Agricultural
Protection Zoning District, with six (6) conditions
listed, carried.
M/Potter, S/Lochner, to approve the
Preliminary Plat #P-00115 a single lot split by
Charles Tews for Tews Farms Inc. known as Tews
First Subdivision, on property described as part
of NE4, Sec. 30T108NR34W, Bashaw Twp.,
Brown County, carried. Property being platted is
an existing farmstead.
M/Berg, S/Potter, to approve the Final Plat #P-
00111 a single lot split by Thomas Grossmann
known as Grossmann First Subdivision, on
property described as part of the SE4, Sec.

carried.

policy/procedures titled: Orientation Guide
effective 4-20-10 as recommended by the Public
Health Advisory Committee, carried.
M/Lochner, S/Berg, to approve the
appointment of Diane Evers as a FT Interim Adult
Health Supervisor for the Public Health Dept. at
the annual salary of $55,979 (Grade XVIII, Step 4)
with a projected start date of 4-26-10, carried.
M/Berg, S/Potter, to approve to retain Terri
Helland and Joan Lindholm as Intermittent Part
Time Public Health Nurses and change the
employment status of Sharon Larson to fully
resigned effective 4-30-10, carried.
M/Berg, S/Potter, to approve the four year
appointment of Wayne Stevens as Brown County
Highway Engineer effective 5-1-10 in accordance
with Minnesota Statutes 163.07, carried.
M/Lochner, S/Potter, to approve the
appointments of Jacob Hoffmann as Summer
Maintenance intern, contingent on passage of
the pre-placement physical, at the hourly rate of
$8.00 and Ben Orth at the hourly rate of $9.00
with projected start date of 5-10-10 and 5-17-
10 respectively, and to approve the appointment
of Eric Vidden as Summer Engineering Intern,
contingent on passage of the pre-placement
physical, at the hourly rate of $8.00 and with a
projected start date of 5-10-10, carried.
M/Berg, S/Potter, to consider appointment of
an additional Summer Maintenance Intern at the
Highway Dept. as departmental staffing levels
are further studied, carried.
M/Lochner, S/Dove, to approve the
appointment of Landon Weckwerth as a FT
Support Enforcement Aide for the Family
Services Dept. at the annual salary of $30,273
(Grade IX, Step 1) contingent on passage of the
pre-placement physical and with a projected
start date of 4-26-10, carried.
M/Lochner, S/Dove, to accept and file the
Minnesota Counties Intergovernmental Trust
(MCIT) 2010 Annual Report as presented by
MCIT Rep. Jennifer Wolf, carried.
Correspondence C-1 thru C-14 were accepted
and filed.
Berg reported on the Region 9 meeting on 4-
14-10; Potter reported on RCRCA; Dove reported
on the Extension meeting on 4-6-10 and on the
Drug Task Force meeting on 4-7-10; Lochner
reported on SCHA, with Potter on the Judicial
Ditch cross-county billing meeting with Redwood
County, Juvenile Detention, and on a Solid Waste
subcommittee meeting.
At 11:42 AM, Chairman Seeboth recessed
the Regular Meeting and the County Board
participated in a Statewide Health Improvement
Program (SHIP) ITV Video Conference at the
Community Services Building.
At 1:16 PM, Chairman Seeboth reconvened
the Regular Meeting in Room 204 of the Brown
County Courthouse.
M/Potter, S/Seeboth, to authorize the payment
of Social Services Administrative claims in the
amount of $158,261.30, carried.
At 1:18 PM, Chairman Seeboth convened
a Closed Session to consider Social Services
Payments, whereupon M/Berg, S/Lochner,
to authorize the payment of Social Services
payments in the amount of $215,855.30, carried.
The Closed Session ended at 1:25 PM.
M/Berg, S/Potter, to accept the quote in the
amount of $52,451.50 from B & H Petroleum to
replace the fuel dispensing system at the Brown
County Highway Dept., carried. An additional
quote was received from Dockendorf.
M/Potter, S/Dove, to accept the quote received
from SMC Sioux Rock Products in the amount of
$16/ton for seal coat chips to be hauled to the #8,
#21, and #24 sites; and from New Ulm Quartzite
Quarries in the amount of $18/ton for seal coat
chips to be hauled to the #11 site, carried.
Additional quotes were received from Red Rock
Quarry.
M/Lochner, S/Berg, to accept the bid received
in the amount of $166,634.36 ($429.47/ton) for
an estimated 388 ton of seal coat oil needed
for 2010 from Flint Hills Resources, carried.
Additional bids were received from the following:
Jebro Inc.; MEIGS Paving Asphalts & Emulsions.
M/Potter, S/Dove, to authorize the Highway
Engineer to submit to the Highway Safety
Improvement Program (HSIP) Project Solicitation
a project on CSAH 27 to add two feet to each side
of the pavement on the west six miles between
Sleepy Eye and New Ulm, carried.
M/Dove, S/Lochner, to direct Administrator
Enter to draft a letter for Board review on 4-
27-10 to appropriation organizations noting
Brown County's intention to honor the budgeted
appropriation for 2010 and to expect some likely
reduction in the appropriation level for 2011,
carried.
Chairman Seeboth appointed Commissioners
Dove and Lochner to serve as an ad hoc
committee of the County Board to review the
study of the possibility of short-term juvenile
detention hold in the county jail.
Calendars were coordinated for the next two
week period.
There being no further business, Chairman
Seeboth adjourned the Meeting at 2:28 PM.
